1 1 Section 1. Section 94.10, Code 1997, is amended to read as
1 2 follows:
1 3 94.10 RECORDS REQUIRED.
1 4 Every person, firm, or corporation operating an employment
1 5 agency or engaged in the business of finding employment for
1 6 others, for which any fee is charged, shall keep a record of
1 7 the applications received and what, if any, employment was
1 8 found or furnished to the applicant, giving the name of each
1 9 applicant and the name and address of the applicant's
1 10 employer, if employment is found, and the fee charged each
1 11 applicant. However, the record requirements of this section
1 12 shall not apply to a person, firm, or corporation operating an
1 13 employment agency or engaged in the business of finding
1 14 employment for others if all fees charged are paid by
1 15 employers and not by applicants.
1 16 Sec. 2. NEW SECTION. 95.7 EMPLOYER-PAID FEE AGENCIES
1 17 EXEMPT.
1 18 The provisions of this chapter shall not apply to an
1 19 employment agency whose fees are paid only by employers.
1 20 EXPLANATION
1 21 This bill exempts from regulation by the labor commissioner
1 22 and the department of workforce development all employment
1 23 agencies whose fees are paid by employers rather than
1 24 applicants.
