1 1 Section 1. NEW SECTION. 7E.8 ISSUANCE OF PERMITS AND
1 2 LICENSES BY STATE AGENCIES – TIME STANDARDS – EXPEDITED
1 3 ISSUANCE.
1 4 An agency, as defined in section 17A.2, shall establish by
1 5 rule, pursuant to chapter 17A, guidelines governing the
1 6 issuance of permits and licenses by that agency. The rule
1 7 shall provide time standards for the issuance of a permit or
1 8 license which shall also provide that any fees required to be
1 9 paid for such issuance shall be refunded if the agency fails
1 10 to comply with the time standard for issuance of that permit
1 11 or license. The rule shall also provide that a person may
1 12 request that the issuance of a permit or license be expedited,
1 13 pursuant to guidelines adopted by the agency, if the person
1 14 pays an additional fee as determined by the agency, not to
1 15 exceed two hundred percent of the regular cost for the permit
1 16 or license, to the agency.
1 17 EXPLANATION
1 18 This bill provides that state agencies shall adopt a rule
1 19 governing the issuance of licenses and permits by that agency.
1 20 The bill requires that the rule provide time standards for the
1 21 issuance of a license or permit and that fees assessed be
1 22 refunded if the standards are not met. The bill also provides
1 23 that a person may, for an additional cost, request an
1 24 expedited issuance of a license or permit. The bill provides
1 25 that the extra cost for expedited issuance not exceed 200
1 26 percent of the regular cost of the license or permit.
