  1  1    Section 1.  NEW SECTION.  103A.7A  MODEL BUILDING CODE FOR
  1  2 CONFINEMENT SWINE FEEDING OPERATIONS.
  1  3    The commissioner shall establish a model building code for
  1  4 animal feeding operation structures which are part of
  1  5 confinement feeding operations which confine swine, as
  1  6 regulated pursuant to chapter 455B.
  1  7    Sec. 2.  Section 331.304, subsection 3, paragraph b, Code
  1  8 1997, is amended to read as follows:
  1  9    b.  A Except as otherwise provided in this paragraph, a
  1 10 county building code shall not apply to farm houses or other
  1 11 farm buildings which are primarily adapted for use for an
  1 12 agricultural purposes purpose, while so used or which are
  1 13 under construction for that use.  The county building code may
  1 14 apply to an animal feeding operation structure which is part
  1 15 of a confinement feeding operation, if the confinement feeding
  1 16 operation confines swine and has an animal weight capacity of
  1 17 more than two hundred thousand pounds, as provided in chapter
  1 18 455B.  However, the county building code shall comply with a
  1 19 state model building code as provided in section 103A.7A.
  1 20    Sec. 3.  ANIMAL AGRICULTURE CONSULTING ORGANIZATION –
  1 21 RECOMMENDATIONS.  In establishing a model building code for
  1 22 animal feeding operation structures which are part of
  1 23 confinement feeding operations which confine swine as provided
  1 24 in section 103A.7A as enacted by this Act, the state building
  1 25 code commissioner shall base the model code on provisions
  1 26 submitted to the commissioner by the animal agriculture
  1 27 consulting organization as created pursuant to 95 Iowa Acts,
  1 28 chapter 195, section 37.  
  1 29                           EXPLANATION
  1 30    This bill amends Code section 331.304 which in part
  1 31 provides that a county building code does not apply to houses
  1 32 or buildings which are primarily adapted for use for an
  1 33 agricultural purpose.  This bill provides that the county
  1 34 building code may apply to an animal feeding operation
  1 35 structure such as a building or manure storage structure which
  2  1 is part of a confinement swine feeding operation having an
  2  2 animal weight capacity of more than two hundred thousand
  2  3 pounds, if the county building code complies with a state
  2  4 model building code for confinement swine feeding operations.
  2  5 In establishing a model building code for confinement swine
  2  6 feeding operations, the state building code commissioner is
  2  7 required to base the model code on provisions submitted to the
  2  8 commissioner by the animal agriculture consulting organization
  2  9 as created in House File 519 enacted in 1995.
