1 1 Section 1. NEW SECTION. 28E.20 TRANSFER OF TITLE IN REAL
1 2 ESTATE BETWEEN STATE AGENCIES.
1 3 A state agency, including a principal central department as
1 4 provided in section 7E.5, shall not require that another state
1 5 agency that holds title to real property, transfer title to
1 6 the real property except as provided pursuant to an agreement
1 7 executed between the state agencies under this chapter.
1 8 Unless otherwise agreed by the parties, all of the following
1 9 shall apply:
1 10 1. The purchase price shall be based on the cost required
1 11 to acquire similar land in the same locality. However, if
1 12 similar land in the same locality is not available, the
1 13 purchase price may be based on the cost required to acquire
1 14 similar land in a comparable locality which is at least
1 15 equally convenient for the state agency transferring title to
1 16 the land.
1 17 2. The purchase price shall include the cost of
1 18 reconstructing structures or facilities which had been used on
1 19 the land subject to a transfer of title by the transferring
1 20 state agency.
1 21 EXPLANATION
1 22 This bill provides that a state agency holding title to
1 23 real property is not required to transfer title in real
1 24 property to another state agency except as provided pursuant
1 25 to an agreement executed between the state agencies under Code
1 26 chapter 28E. The bill provides that the purchase price shall
1 27 be based on the cost required to acquire similar land in the
1 28 same locality or a locality convenient to the transferring
1 29 state agency, and shall include the cost of reconstructing
1 30 structures or facilities which had been used by the
1 31 transferring state agency.
