  1  4 TO PROHIBIT SEX ACTS WHEN ONE PARTICIPANT WAS PREVENTED
  1  5    FROM CONSENTING BY A CONTROLLED SUBSTANCE INCLUDING
  1  6    FLUNITRAZEPAM, AND PROVIDING PENALTIES.
  1  7 
  1  8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 
  1  9 
  1 10    Section 1.  Section 709.4, Code 1997, is amended by adding
  1 11 the following new subsection:
  1 12    NEW SUBSECTION.  3.  The act is performed while the other
  1 13 participant is under the influence of a controlled substance,
  1 14 which may include but is not limited to flunitrazepam, and all
  1 15 of the following are true:
  1 16    a.  The controlled substance which may include but is not
  1 17 limited to flunitrazepam, has been consumed by or administered
  1 18 to the other participant without the other participant's
  1 19 knowledge.
  1 20    b.  The controlled substance, which may include but is not
  1 21 limited to flunitrazepam, prevents the other participant from
  1 22 consenting to the act.
  1 23    c.  The person performing the act knows or reasonably
  1 24 should have known that the other participant was under the
  1 25 influence of the controlled substance, which may include but
  1 26 is not limited to flunitrazepam.
