PAG LIN 1 1 Section 1. Section 237A.3, subsection 1, paragraph c, 1 2 unnumbered paragraph 1, Code 1997, is amended to read as 1 3 follows: 1 4 A family day care home may provide care in accordance with 1 5 this subsection for more than six but less than twelve 1 6 children for two hours or more during a day with inclement 1 7 weather following the cancellation of school classes. The 1 8 home must have prior written approval from the parent or 1 9 guardian of each child present in the home concerning the 1 10 presence of excess children in the home pursuant to this 1 11 paragraph. The home must have a responsible individual, age 1 12fourteentwelve or older, on duty to assist the home provider 1 13 when more than six children are present in accordance with the 1 14 provisions of this paragraph. In addition, one or more of the 1 15 following conditions shall apply to each child present in the 1 16 home in excess of six children: 1 17 Sec. 2. Section 237A.3, subsection 2, Code 1997, is 1 18 amended to read as follows: 1 19 2. A person shall not operate or establish a group day 1 20 care home unless the person obtains a certificate of 1 21 registration under this chapter. In order to be registered, 1 22 the group day care home shall have at least one responsible 1 23 individual, agefourteentwelve or older, on duty to assist 1 24 the group day care home provider when there are more than six 1 25 children present for more than a two-hour period. All other 1 26 requirements of this chapter for registered family day care 1 27 homes and the rules adopted under this chapter for registered 1 28 family day care homes apply to group day care homes. In 1 29 addition, the department shall adopt rules relating to the 1 30 provision in group day care homes for a separate area for sick 1 31 children. In consultation with the state fire marshal, the 1 32 department shall adopt rules relating to the provision of fire 1 33 extinguishers, smoke detectors, and two exits accessible to 1 34 children. 1 35 EXPLANATION 2 1 This bill relates to requirements for group day care homes 2 2 involving responsible individuals who assist a provider. 2 3 The bill amends Code section 237A.3 which provides 2 4 registration requirements applicable to family and group day 2 5 care homes. Under current law, a group day care home may 2 6 provide care for up to 11 children at one time and a family 2 7 day care home may provide care for up to six children at one 2 8 time. However, both types of provider may provide care for 2 9 additional children during certain periods of inclement 2 10 weather. If more than six children are present, current law 2 11 requires the provider to have a responsible person on duty to 2 12 assist the provider. The bill reduces the minimum required 2 13 age of the responsible person from age 14 to age 12. 2 14 LSB 1617HH 77 2 15 jp/cf/24
