1 4 RELATING TO WORKERS' COMPENSATION BENEFITS FOR PROFESSIONAL
1 5 ATHLETES AND PROVIDING AN EFFECTIVE DATE.

1 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 9 Section 1. Section 85.33, Code 1997, is amended by adding
1 10 the following new subsection:
1 11 NEW SUBSECTION. 6. For purposes of this section and
1 12 section 85.34, subsection 1, "employment substantially similar
1 13 to the employment in which the employee was engaged at the
1 14 time of the injury" includes, for purposes of an individual
1 15 who was injured in the course of performing as a professional
1 16 athlete, any employment the individual has previously
1 17 performed.
1 18 Sec. 2. Section 85.34, Code 1997, is amended by adding the
1 19 following new subsection:
1 20 NEW SUBSECTION. 6. PROFESSIONAL ATHLETE. For purposes of
1 21 subsection 2, paragraph "u", a determination of the degree of
1 22 permanent disability of an individual who was injured in the
1 23 course of performing as a professional athlete shall not be
1 24 determined based upon employment as a professional athlete but
1 25 shall be determined based upon other occupations the
1 26 individual has previously performed or was reasonably suited
1 27 to perform at the time of the injury.
1 28 Sec. 3. Section 85.36, Code 1997, is amended by adding the
1 29 following new subsection:
1 30 NEW SUBSECTION. 12. In the case of an employee injured in
1 31 the course of performing as a professional athlete, the basis
1 32 of compensation for weekly earnings shall be one-fiftieth of
1 33 total earnings which the employee has earned from all
1 34 employment for the previous twelve months prior to the injury.
1 35 Sec. 4. EFFECTIVE DATE. This Act, being deemed of
2 1 immediate importance, takes effect upon enactment.
