  1  1    Section 1.  Section 260C.14, Code 1997, is amended by
  1  2 adding the following new subsection:
  1  3    NEW SUBSECTION.  22.  Prohibit the enrollment of a male
  1  4 individual as a student, and shall not award any individual a
  1  5 state-supported loan, grant, or scholarship, if the individual
  1  6 is between the ages of eighteen and twenty-six years and has
  1  7 not registered with the federal selective service system in
  1  8 accordance with the federal Military Selective Service Act, 50
  1  9 U.S.C. App. 453, as amended.  The board shall include as part
  1 10 of the community college admission form a statement of
  1 11 selective service, which shall be filled out by any male
  1 12 applicant between the ages of eighteen and twenty-six years.
  1 13 The statement shall include space for the applicant to record
  1 14 the selective service number assigned to the applicant and
  1 15 shall certify one of the following:
  1 16    a.  That the applicant has registered with the selective
  1 17 service system in accordance with the Military Selective
  1 18 Service Act, 50 U.S.C. App. 453, as amended.
  1 19    b.  That the applicant is not required to register with the
  1 20 selective service system for one of the following reasons:
  1 21    (1)  The applicant is on active duty with the armed forces
  1 22 of the United States other than for training in a reserve or
  1 23 national guard unit.
  1 24    (2)  The applicant is a nonimmigrant alien lawfully in the
  1 25 United States in accordance with section 101(a)(15) of the
  1 26 federal Immigration and Nationality Act, 8 U.S.C. } 1101, as
  1 27 amended.
  1 28    (3)  The applicant is not a citizen of the United States
  1 29 and is a permanent resident of the trust territory of the
  1 30 Pacific Islands or the Northern Mariana Islands.
  1 31    If the institution enrolls a male applicant who is less
  1 32 than eighteen years of age, the community college shall
  1 33 require the student to file a revised statement of selective
  1 34 service status after reaching the age of eighteen. The
  1 35 community college shall not enroll the student in another
  2  1 semester, or award or renew a state-supported loan, grant, or
  2  2 scholarship to the student until the student submits a
  2  3 statement certifying that the student is registered with the
  2  4 federal selective service system or is exempt from
  2  5 registration.  For an applicant not required to register with
  2  6 the federal selective service system, the statement shall
  2  7 include space for certification of nonregistration and for an
  2  8 explanation of the reason for the exemption.  The board may
  2  9 require that the statement be accompanied by any documentation
  2 10 the board deems necessary.
  2 11    Sec. 2.  Section 262.9, Code 1997, is amended by adding the
  2 12 following new subsection:
  2 13    NEW SUBSECTION.  30.  Prohibit the institutions of higher
  2 14 learning under its control from enrolling a male individual as
  2 15 a student, and from awarding the individual a state-supported
  2 16 loan, grant, or scholarship if the individual is between the
  2 17 ages of eighteen and twenty-six years and has not registered
  2 18 with the federal selective service system in accordance with
  2 19 the federal Military Selective Service Act, 50 U.S.C. App.
  2 20 453, as amended.  Each institution of higher learning under
  2 21 the control of the regents is directed to include as part of
  2 22 its admission form a statement of selective service, which
  2 23 shall be filled out by any male applicant between the ages of
  2 24 eighteen and twenty-six years.  The statement shall include
  2 25 space for the applicant to record the selective service number
  2 26 assigned to the applicant and shall certify one of the
  2 27 following:
  2 28    a.  That the applicant has registered with the selective
  2 29 service system in accordance with the Military Selective
  2 30 Service Act, 50 U.S.C. App. 453, as amended.
  2 31    b.  That the applicant is not required to register with the
  2 32 selective service system for one of the following reasons:
  2 33    (1)  The applicant is on active duty with the armed forces

  3 23    Sec. 3.  EFFECTIVE DATE.  This Act, being deemed of
  3 24 immediate importance, takes effect upon enactment and applies
  3 25 to individuals applying for admission on or after the
  3 26 effective date of this Act.  
  3 27                           EXPLANATION
  3 28    This bill directs the state board of regents and the boards
  3 29 of directors for the community colleges to prohibit the
  3 30 institutions of higher learning under their control from
  3 31 enrolling a male individual as a student, and from awarding
  3 32 any individual a state-supported loan, grant, or scholarship,
  3 33 if the individual is between the ages of 18 and 26 years and
  3 34 has not registered with the federal selective service system
  3 35 in accordance with the federal Military Selective Service Act.
  4  1    Each institution or board is directed to include on its
  4  2 admission form a statement of selective service, which shall
  4  3 be filled out by any male applicant between the ages of 18 and
  4  4 26.  The statement shall include space for the applicant to
  4  5 record the selective service number assigned to the applicant
  4  6 and to either indicate that the applicant is registered or
  4  7 explain why the applicant is not required to register.
  4  8    A male student who enrolled at less than 18 years of age is
  4  9 required to file a revised statement of selective service
  4 10 status after reaching the age of 18, and until the student
  4 11 does, the student shall not be enrolled in another semester,
  4 12 or awarded, or receive a renewal for, a state-supported loan,
  4 13 grant, or scholarship.  For those applicants not required to
  4 14 register with the federal selective service system, the
  4 15 statement shall include space for certification of
  4 16 nonregistration and for an explanation of the reason for the
  4 17 exemption.  The board may require that the statements be
  4 18 accompanied by documentation.
  4 19    The bill takes effect upon enactment and applies to
  4 20 individuals applying for admission on or after the date on
  4 21 which the bill takes effect.
