1 1 Section 1. Section 321.182, Code 1997, is amended by
1 2 adding the following new subsections:
1 3 NEW SUBSECTION. 5. Certify that the applicant, if a minor
1 4 who has not previously been issued a class C1 or class M1
1 5 motor vehicle license under section 321.189, subsection 1,
1 6 paragraph "f" or "g", meets the requirements for issuance of a
1 7 motor vehicle license under those paragraphs.
1 8 NEW SUBSECTION. 6. Certify that the applicant, if a minor
1 9 who has been operating a motor vehicle under a class C1 or
1 10 class M1 motor vehicle license, satisfies the criteria
1 11 necessary to be issued a regular motor vehicle license.
1 12 Sec. 2. Section 321.184, subsection 1, Code 1997, is
1 13 amended by adding the following new unnumbered paragraph:
1 14 NEW UNNUMBERED PARAGRAPH. The parent, guardian, or person
1 15 having custody of the applicant under chapter 600A shall also
1 16 verify that the person has supervised the applicant's driving
1 17 for the periods required by section 321.189, subsection 1,
1 18 paragraph "f" or "g".
1 19 Sec. 3. Section 321.189, subsection 1, Code 1997, is
1 20 amended by adding the following new paragraphs:
1 21 NEW PARAGRAPH. f. Class C1 – Valid for the operation of
1 22 a motor vehicle if the following conditions are met:
1 23 (1) The person issued the license is sixteen years of age.
1 24 (2) The person issued the license has held an instruction
1 25 permit issued under section 321.180 for at least six months.
1 26 (3) The person has completed at least fifty hours of
1 27 supervised driving including at least ten hours of supervised
1 28 driving during hours of darkness.
1 29 (4) The person has operated a motor vehicle under the
1 30 permit for at least the three most recent months prior to
1 31 issuance of the license without an accident or violation,
1 32 other than a parking violation under section 321.210.
1 33 (5) The person has completed an approved driver education
1 34 course.
1 35 A class C1 license shall authorize the holder to operate
2 1 the same motor vehicles as a class C license holder, except
2 2 that a person issued a class C1 license shall not operate a
2 3 motor vehicle between the hours of midnight and five a.m.
2 4 unless the person is accompanied by a parent or guardian or is
2 5 going to or from the person's place of employment.
2 6 NEW PARAGRAPH. g. Class M1 – Valid for the operation of
2 7 a motorcycle if the following conditions are met:
2 8 (1) The person issued the license is sixteen years of age.
2 9 (2) The person issued the license has held an instruction
2 10 permit issued under section 321.180 for at least six months.
2 11 (3) The person has completed the required number of
2 12 supervised driving hours.
2 13 (4) The person has operated a motor vehicle under the
2 14 permit for at least the three most recent months prior to
2 15 issuance of the license without an accident or violation,
2 16 other than a parking violation under section 321.210.
2 17 (5) The person has completed an approved driver education
2 18 course and an approved motorcycle education course.
2 19 A class M1 license shall authorize the holder to operate a
2 20 motorcycle as under a class M license, except that a person
2 21 issued a class M1 license shall not operate a motorcycle
2 22 between the hours of midnight and five a.m. unless the person
2 23 is accompanied by a parent or guardian or is going to or from
2 24 the person's place of employment.
2 25 Sec. 4. Section 321.189, subsection 1, Code 1997, is
2 26 amended by adding the following new unnumbered paragraph:
2 27 NEW UNNUMBERED PARAGRAPH. Unless the person is subject to
2 28 section 321.178, subsection 3, a license under paragraphs "a"
2 29 through "e" shall only be issued to a person seventeen years
2 30 of age who has held a license under paragraph "f" or "g" for
2 31 at least six months and who has had no accidents or
2 32 violations, other than parking violations under section
2 33 321.210, for at least the three months preceding the issuance
2 34 of a license under paragraphs "a" through "e".
2 35 Sec. 5. EFFECTIVE AND APPLICABILITY DATES. This Act takes
3 1 effect on July 1, 1997, for the purpose of adoption of rules
3 2 by the department of transportation. The Act is applicable to
3 3 licenses issued to minors on and after July 1, 1998.
3 4 EXPLANATION
3 5 This bill establishes a multistep process for obtaining a
3 6 driver's license for minors. Beginning July 1, 1998, a minor
3 7 who is issued a driver's license shall first have held an
3 8 instruction permit for at least six months, have logged at
3 9 least 50 hours of supervised driving, at least 10 hours of
3 10 which shall be during hours of darkness, shall not have any
3 11 traffic accidents or violations, other than parking
3 12 violations, during the three months preceding issuance of the
3 13 license, and shall have completed an approved driver education
3 14 course. The bill creates new licenses specifically for 16-
3 15 year-olds. These licenses, class C1 for motor vehicles other
3 16 than motorcycles and class M1 for motorcycles, restrict
3 17 operation of a motor vehicle to between the hours of 5 a.m.
3 18 and midnight unless the license holder is accompanied by a
3 19 parent or guardian or traveling to or from the person's job.
3 20 In order to obtain a regular driver's license, a person has
3 21 to be 17 years of age, have held a class C1 or M1 license for
3 22 at least six months, and have no accidents or traffic
3 23 violations other than parking violations for the three months
3 24 immediately preceding issuance of a regular license.
3 25 The bill takes effect July 1, 1997, for the purpose of
3 26 adoption of rules by the department of transportation. The
3 27 bill is applicable to licenses issued to minors on and after
3 28 July 1, 1998.
