1 1 Section 1. DISASTER EMERGENCY SCHOOL CALENDAR WAIVER. For
1 2 the school year beginning July 1, 1996, and ending June 30,
1 3 1997, the director of the department of education shall waive
1 4 the one-hundred-eighty-day school calendar requirement set
1 5 forth in section 279.10, subsection 1, as provided by this
1 6 section, for an accredited nonpublic school or public school
1 7 district that submits a written request if the school or
1 8 school district is located in a county proclaimed by the
1 9 governor to be a disaster emergency area. A school or school
1 10 district is eligible for this section only if the school or
1 11 school district's calendar was reduced by more than fifteen
1 12 days due to the disaster conditions and only school days
1 13 canceled due to disaster conditions in excess of fifteen days
1 14 may be waived.
1 15 Sec. 2. This Act, being deemed of immediate importance,
1 16 takes effect upon enactment.
1 17 EXPLANATION
1 18 This bill directs the director of the department of
1 19 education to waive, during the school year beginning July 1,
1 20 1996, and ending June 30, 1997, the 180-day school calendar
1 21 under certain conditions. To be eligible for a waiver, an
1 22 accredited nonpublic school or school district that applies
1 23 for a waiver must be located in a county proclaimed by the
1 24 governor to be a disaster emergency area. The school or
1 25 school district's calendar must have been reduced by more than
1 26 15 days due to the disaster conditions, and only those days
1 27 canceled due to the disaster conditions in excess of 15 days
1 28 may be waived.
1 29 The governor issued a disaster emergency proclamation on
1 30 January 29, 1997, for counties that experienced several severe
1 31 winter storm systems since January 9, including Cherokee,
1 32 Clay, Dickinson, Emmet, Kossuth, Lyon, O'Brien, Osceola, Palo
1 33 Alto, Plymouth, and Sioux counties.
