PAG LIN 1 1 Section 1. Section 321.40, unnumbered paragraph 4, Code 1 2 1997, is amended to read as follows: 1 3 The county treasurer shall refuse to renew the registration 1 4 of a vehicle registered to a person when notifiedthat the1 5person has not paid restitution as defined under section1 6910.1, subsection 4, to the clerk of the court located within1 7that countyby the department through the distributed 1 8 teleprocessing network that the person has not paid 1 9 restitution as defined under section 910.1, subsection 4, to a 1 10 clerk of court located in this state. The judicial department 1 11 shall notify the state department of transportation on a daily 1 12 basis through the Iowa court information system of the full 1 13 names and social security numbers of persons whose restitution 1 14 obligations become delinquent or whose restitution obligations 1 15 have been cancelled or satisfied.Each clerk of court subject1 16to this section shall, by the last day of each month, notify1 17the county treasurer of that county of all persons who owe1 18delinquent restitution. Immediately upon the cancellation or1 19satisfaction of the restitution the clerk of court shall1 20notify the county treasurer if that person's name appeared on1 21the last list furnished to the county treasurer.This 1 22 paragraph does not apply to the transfer of a registration or 1 23 the issuance of a new registration. The provisions of this 1 24 paragraph are applicable to counties with a population of 1 25 twenty-five thousand or more. The provisions of this 1 26 paragraph shall be applicable to any county with a population 1 27 of less than twenty-five thousand upon the adoption of a 1 28 resolution by the county board of supervisors so providing. 1 29 EXPLANATION 1 30 This bill provides that a county treasurer shall refuse to 1 31 renew the vehicle registration of a person who has not paid 1 32 restitution when the treasurer is notified of that fact by the 1 33 state department of transportation through the department's 1 34 distributed teleprocessing network. The judicial department 1 35 shall notify the state department of transportation on a daily 2 1 basis through the Iowa court information system of the names 2 2 and social security numbers of persons whose restitution 2 3 obligations have become delinquent or have been satisfied or 2 4 cancelled. Currently, registration renewals are to be refused 2 5 only when the person owes restitution to the clerk of court in 2 6 the county where the person seeks to renew the registration. 2 7 LSB 1654HH 77 2 8 mk/cf/24
