1 1 Section 1. The requirement contained in section 279.10
1 2 that the school year shall continue for at least one hundred
1 3 eighty days following the commencement of the school year
1 4 shall be subject to a waiver where the school calendar has
1 5 been extended beyond its anticipated conclusion date due to
1 6 inclement weather.
1 7 For the school year beginning July 1, 1996, if the school
1 8 calendar has been extended due to inclement weather, such that
1 9 school will remain in session beyond June 6, 1997, in order to
1 10 comply with the one hundred eighty day requirement, a school
1 11 may be granted a waiver from that requirement provided
1 12 students have completed all curriculum requirements for the
1 13 school year. Upon written request, certified by the board of
1 14 directors of a school district, filed not later than May 15,
1 15 1997, the director of the department of education may grant
1 16 the waiver. The request shall be made on forms furnished by
1 17 the department. In reviewing the request, the director shall
1 18 consider the total school calendar of the district and its
1 19 good faith effort to make up days school was not in session
1 20 prior to June 6, 1997.
1 21 Sec. 2. This Act, being deemed of immediate importance,
1 22 takes effect upon enactment.
1 23 EXPLANATION
1 24 This bill provides that a school district may be granted a
1 25 waiver from the 180 day school year duration requirements of
1 26 Code section 279.10 where the school calendar has been
1 27 extended due to inclement weather beyond June 6, 1997. A
1 28 school district seeking a waiver shall apply to the director
1 29 of the department of education, who shall consider the total
1 30 school calendar of the district and its good faith effort to
1 31 make up the missed school days prior to June 6, 1997. The
1 32 bill contains an immediate effective date.
