  1  4 REQUIRING CRIMINAL AND CHILD ABUSE RECORD CHECKS OF PERSONS
  1  5    RECEIVING STATE FUNDING FOR PROVIDING CHILD DAY CARE,
  1  6    AND MAKING A PENALTY APPLICABLE.

  1  8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  9 
  1 10    Section 1.  Section 237A.5, Code 1997, is amended by adding
  1 11 the following new subsection:
  1 12    NEW SUBSECTION.  6.  A person who receives public funds for
  1 13 providing child day care and who is not registered or licensed
  1 14 under this chapter and individuals who reside with the person
  1 15 shall be subject to the provisions of subsection 2 as though
  1 16 the person either is being considered for registration or is
  1 17 registered to provide child day care under this chapter.  If
  1 18 the person or individual residing with the person would be
  1 19 prohibited from licensure, registration, employment, or
  1 20 residence under subsection 2, the person shall not provide
  1 21 child day care and is not eligible to receive public funds to
  1 22 do so.  A person who continues to provide child day care in
  1 23 violation of this subsection is subject to penalty under
  1 24 section 237A.19 and injunction under section 237A.20.
