1 1 Section 1. Section 252.16, subsection 8, Code 1997, is
1 2 amended to read as follows:
1 3 8. a. A person receiving treatment or support services
1 4 from any community-based provider of treatment or services for
1 5 mental retardation, developmental disabilities, mental health,
1 6 or substance abuse does not acquire legal settlement in the
1 7 host county unless the person continuously resides in the host
1 8 county for one year from the date of the last treatment or
1 9 support service received by the person.
1 10 b. For the purposes of this subsection:
1 11 (1) "Community-based provider" means a public or private
1 12 entity which provides treatment or services for mental
1 13 retardation, developmental disabilities, mental health, or
1 14 substance abuse in a community setting through contract,
1 15 purchase of services, or other arrangement with a public
1 16 entity, regardless of the geographic area served by the public
1 17 or private entity providing such treatment or services.
1 18 (2) "Host county" means the county in which the site of
1 19 the community-based provider is located which is providing
1 20 treatment or services to the person.
1 21 EXPLANATION
1 22 This bill defines "community-based provider" and "host
1 23 county" for the purposes of determining the county of legal
1 24 settlement of a person receiving treatment or services for
1 25 mental retardation, developmental disabilities, mental health,
1 26 or substance abuse.
