1 1 Section 1. Section 400.27, unnumbered paragraph 2, Code
1 2 l997, is amended by striking the unnumbered paragraph and
1 3 inserting in lieu thereof the following:
1 4 The civil service commission may employ legal counsel to
1 5 represent the commission or to present matters concerning
1 6 civil service employees to the commission. The legal counsel
1 7 shall not be the city attorney or solicitor or the city
1 8 attorney, solicitor, or legal counsel for any other city in
1 9 this state. The city shall pay the costs incurred by the
1 10 commission in employing an attorney pursuant to this section.
1 11 Sec. 2. Section 25B.2, subsection 3, shall not apply to
1 12 this Act.
1 13 EXPLANATION
1 14 This bill provides that a city civil service commission may
1 15 employ a legal counsel to represent the commission or present
1 16 matters concerning civil service employees to the commission.
1 17 However, the legal counsel shall not be the city attorney or
1 18 solicitor or the city attorney, solicitor, or legal counsel
1 19 for any other city in the state.
1 20 This bill may include a state mandate as defined in section
1 21 25B.3. This bill makes inapplicable section 25B.2, subsection
1 22 3, which would relieve a political subdivision from complying
1 23 with a state mandate if the funding for the cost of the state
1 24 mandate is not provided for or specified. Therefore,
1 25 political subdivisions are required to comply with any state
1 26 mandate included in this bill.
