PAG LIN 1 1 Section 1. Section 341A.11, unnumbered paragraph 1, Code 1 2 1997, is amended to read as follows: 1 3 The tenure of every deputy sheriff holding an office or 1 4 position of employment under the provisions of this chapter 1 5 shall be conditional upon a probationary period of not more 1 6 thantwelveeighteen months, and where such deputy sheriff1 7attends the law enforcement academy or a regional training1 8facility certified by the director of the Iowa law enforcement1 9academy, a probationary period of not more than six months,1 10 during which time the appointee may be removed or discharged 1 11 by the sheriff. Thereafter, the deputy sheriff may be removed 1 12 or discharged, suspended without pay, demoted, or reduced in 1 13 rank, or deprived of vacation privileges or other privileges 1 14 for any of the following reasons: 1 15 Sec. 2. Section 400.8, subsection 3, Code 1997, is amended 1 16 to read as follows: 1 17 3. All appointments to such positions shall be conditional 1 18 upon aprobationprobationary period of not to exceed six 1 19 months, and in the case ofpolice patrol officers,police 1 20 dispatchers,and fire fighters aprobationprobationary period 1 21 not to exceed twelve months. However, appointments to 1 22 positions of police patrol officers shall be conditional upon 1 23 a probationary period of not to exceed eighteen months, and in 1 24 cities with a population over one hundred seventy-five 1 25 thousand, appointments to the position of fire fighter shall 1 26 be conditional upon aprobationprobationary period of not to 1 27 exceed twenty-four months. During theprobationprobationary 1 28 period, the appointee may be removed or discharged from such 1 29 position by the appointing person or body without the right of 1 30 appeal to the commission. A person removed or discharged 1 31 during a probationary period shall, at the time of discharge, 1 32 be given a notice in writing stating the reason or reasons for 1 33 the dismissal. A copy of such notice shall be promptly filed 1 34 with the commission. Continuance in the position after the 1 35 expiration of such probationary period shall constitute a 2 1 permanent appointment. 2 2 EXPLANATION 2 3 The bill provides for the extension of the probationary 2 4 employment period for police patrol officers and for deputy 2 5 sheriffs from 12 to 18 months. 2 6 LSB 1518HH 77 2 7 tj/jj/8.1
