PAG LIN 1 1 HOUSE FILE 125 1 2 1 3 AN ACT 1 4 APPROPRIATING FEDERAL BLOCK GRANT FUNDS AND AMENDING 1 5 APPROPRIATIONS FROM THE GENERAL FUND OF THE STATE TO 1 6 THE DEPARTMENT OF HUMAN SERVICES FOR THE STATE FISCAL 1 7 YEAR BEGINNING JULY 1, 1996, AND PROVIDING AN EFFECTIVE 1 8 DATE. 1 9 1 10 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 11 1 12 Section 1. TEMPORARY ASSISTANCE FOR NEEDY FAMILIES BLOCK 1 13 GRANT. There is appropriated from the fund created in section 1 14 8.41 to the department of human services for the fiscal year 1 15 beginning July 1, 1996, and ending June 30, 1997, from moneys 1 16 received under the federal temporary assistance for needy 1 17 families block grant pursuant to the federal Personal 1 18 Responsibility and Work Opportunity Reconciliation Act of 1 19 1996, Pub. L. No. 104-193, which were appropriated for the 1 20 federal fiscal year beginning October 1, 1996, and ending 1 21 September 30, 1997, the following amounts to be used for the 1 22 purposes designated: 1 23 Moneys appropriated in this section shall be used in 1 24 accordance with the federal law making the funds available, 1 25 applicable Iowa law, and administrative rules adopted to 1 26 implement the federal and Iowa law. If actual federal 1 27 revenues credited to the fund created in section 8.41 through 1 28 June 30, 1997, are less than the amounts appropriated in this 1 29 section, the amounts appropriated shall be reduced 1 30 proportionately and the department may reduce expenditures as 1 31 deemed necessary by the department to meet the reduced funding 1 32 level: 1 33 1. For assistance under the family investment program 1 34 under chapter 239 and in accordance with 1996 Iowa Acts, 1 35 chapter 1213, section 1: 1 36 .................................................. $ 71,040,801 2 1 For the fiscal year beginning July 1, 1996, the department 2 2 shall continue the practice of depositing child support 2 3 assigned to the state under the family investment program into 2 4 the family investment program appropriation. However, if the 2 5 federal government reduces the amount of federally 2 6 reimbursable administrative costs for child support payable to 2 7 the state, then not more than an amount equivalent to the 2 8 reduction may be deposited into the appropriation for that 2 9 fiscal year to the department for child support recovery. 2 10 Moneys deposited in accordance with this paragraph are 2 11 appropriated for the purposes of the appropriation to which 2 12 the moneys are deposited. 2 13 2. For the federal-state job opportunities and basic 2 14 skills (JOBS) program, and implementing family investment 2 15 agreements, in accordance with 1996 Iowa Acts, chapter 1213, 2 16 section 7: 2 17 .................................................. $ 6,144,890 2 18 3. To supplement the appropriation and allocation for 2 25 local administrative costs and other local services made in 2 26 1996 Iowa Acts, chapter 1210, section 10, subsection 3, 2 27 paragraph "d": 2 28 .................................................. $ 1,495,176 2 29 6. To supplement the appropriations made in 1996 Iowa 2 30 Acts, chapter 1218, section 14, subsections 1 and 2: 2 31 a. For training, maintenance, and upgrades of computer 2 32 software: 2 33 .................................................. $ 200,758 2 34 b. For the development costs of the "X-PERT" knowledge- 2 35 based computer software package for public assistance benefit 2 36 eligibility determination, including salaries, support, 2 37 maintenance, and miscellaneous purposes: 3 1 .................................................. $ 183,297 3 2 Notwithstanding section 8.33, moneys appropriated in this 3 3 section of this Act which remain unencumbered or unobligated 3 4 at the close of the fiscal year shall not revert from the fund 3 5 from which appropriated but shall remain available for the 3 6 purpose designated in the succeeding fiscal year. 3 7 Sec. 2. 1996 Iowa Acts, chapter 1213, section 1, 3 8 unnumbered paragraph 2, is amended to read as follows: 3 9 For assistance under the family investment program under 3 10 chapter 239: 3 11 .................................................. $34,787,2553 12 16,683,536 3 13 Sec. 3. 1996 Iowa Acts, chapter 1213, section 6, 3 14 unnumbered paragraph 2, and subsection 1, are amended to read 3 15 as follows: 3 16 For protective child day care assistance and state child 3 17 care assistance: 3 18 .................................................. $12,547,1003 19 13,271,301 3 20 1. Of the funds appropriated in this section,$2,496,2863 21 $3,220,487 shall be used for protective child day care 3 22 assistance. 3 23 Sec. 4. 1996 Iowa Acts, chapter 1213, section 10, 3 24 unnumbered paragraph 2, is amended to read as follows: 3 25 For child and family services: 3 26 .................................................. $85,460,6073 27 95,907,604 3 28 Sec. 5. 1996 Iowa Acts, chapter 1213, section 10, 3 29 subsection 9, is amended to read as follows: 3 30 9. Notwithstanding section 234.35, subsection 1, for the 3 31 fiscal year beginning July 1, 1996, state funding for shelter 3 32 care paid pursuant to section 234.35, subsection 1, paragraph 3 33 "h", shall be limited to $3,223,7325,914,676. The department 3 34 shall develop a formula in consultation with the shelter care 3 35 committee created by the department to allocate shelter care 3 36 funds to the department's regions. The formula shall be based 4 1 on the region's proportion of the state population of children 4 2 and historical usage. The department may adopt emergency 4 3 rules to implement the provisions of this subsection. 4 4 Sec. 6. 1996 Iowa Acts, chapter 1213, section 21, 4 5 unnumbered paragraph 2, is amended to read as follows: 4 6 For field operations, including salaries, support, 4 7 maintenance, and miscellaneous purposes and for not more than 4 8 the following full-time equivalent positions: 4 9 .................................................. $38,483,9984 10 44,796,369 4 11 ............................................... FTEs 401.00 4 20 Sec. 8. TRANSFER AUTHORITY. Subject to the provisions of 4 21 section 8.39, for the fiscal year beginning July 1, 1996, if 4 22 necessary to meet federal maintenance of effort requirements, 4 23 the department of human services may transfer between any of 4 24 the appropriations made to the department for the following 4 25 purposes in adjusting for funding that the state would have 4 26 previously been eligible to receive as federal matching funds 4 27 under Titles IV-A and IV-F of the federal Social Security Act, 4 28 provided that the combined amount of state and federal 4 29 temporary assistance for needy families block grant funding 4 30 for each appropriation remains the same before and after the 4 31 transfer: 4 32 1. For the family investment program made in this Act and 4 33 in 1996 Iowa Acts, chapter 1213. 4 34 2. For child day care assistance made in this Act and in 4 35 1996 Iowa Acts, chapters 1210 and 1213. 5 1 3.
