1 1 Section 1. Section 232.75, subsection 2, Code 1997, is
1 2 amended to read as follows:
1 3 2. Any person, official, agency or institution, required
1 4 by section 232.69 to report a suspected case of child abuse
1 5 who knowingly fails to do so is civilly liable for the damages
1 6 proximately caused by such failure. However, in an action for
1 7 damages against a licensed school employee based on the
1 8 alleged knowing and willful failure of the employee to report
1 9 a suspected case of child abuse, the damages awarded to a
1 10 complainant are limited to fifty thousand dollars.
1 11 EXPLANATION
1 12 This bill limits the damages a complaintant may be awarded
1 13 in an action against a licensed school employee, based on the
1 14 alleged knowing and willful failure of the employee to report
1 15 a suspected case of child abuse, to $50,000.
