PAG LIN 1 1 Section 1. Section 328.21, Code 1997, is amended to read 1 2 as follows: 1 3 328.21 AIRCRAFT REGISTRATION FEES. 1 4ThereA biennial registration fee for each such aircraft 1 5 shall be paid to the department at the time of such 1 6 registrationan annual registration fee for each such1 7aircraft, to be computedas follows: 1 8 1. Unless otherwise provided in this section,for the1 9first registration, a sum equal to one and one-half percent of1 10the manufacturer's list price of the aircraftthe registration 1 11 fee is twenty dollars. 1 122. The second year's registration fee is seventy-five1 13percent of the rate fixed for the first registration; the1 14third year's fee is fifty percent; and the fourth and1 15subsequent year's fee is twenty-five percent; however, an1 16aircraft shall not be registered for a fee of less than1 17thirty-five dollars.1 183.2. The registration fee for an aircraft operated in 1 19 scheduled interstate airline operation, owned by an Iowa 1 20 person and operated part-time within this state shall be a fee 1 21 of one hundred dollars. The application for registration 1 22 shall be supported by such records as the department shall 1 23 prescribe. 1 244. Should the department find and determine that no1 25established manufacturer's list price exists for any such1 26aircraft the department is hereby authorized and empowered to1 27determine and fix the fair value of such aircraft which fair1 28value shall be used in lieu of a manufacturers' list price in1 29computing the registration fee for each such aircraft as1 30otherwise provided by this section.1 31When the fee as so computed results in a fractional part of1 32a dollar, it shall be computed to the nearest dollar.1 335.3. An aircraft thirty years old or older, which is used 1 34 exclusively for noncommercial purposes, shall be registered as 1 35 an antique aircraft for a fee of thirty-five dollars. 2 16.4. An aircraft, unless exempt under section 328.35, 2 2 which is damaged, is not airworthy, and is not in flying 2 3 condition is not subject to registration fees if the owner of 2 4 the aircraft submits information required by the department. 2 5 Upon receipt of that information, the department shall issue a 2 6 certificate which states that the registration fee has not 2 7 been paid and that the aircraft shall not use the airports or 2 8 the air space overlying the state until the fee has been paid. 2 97.5. The registration fee for a helicopter used 2 10 exclusively as an air ambulance is one thousand dollars. 2 118.6. An aircraft owned and operated by an aviation 2 12 business located at a publicly owned, public use airport and 2 13 providing, under agreement with the governing body of the 2 14 airport, a specified minimum level of aviation services to the 2 15 general public, shall be registered for a fee of one hundred 2 16 dollars. 2 17 Sec. 2. Sections 328.22 and 328.24, Code 1997, are 2 18 repealed. 2 19 EXPLANATION 2 20 This bill sets the fee for registering certain aircraft in 2 21 Iowa at $20 every two years. Currently, the registration fee 2 22 is calculated by a formula based on an initial registration 2 23 fee of 1.5 percent of the original list price of the aircraft 2 24 and decreasing to 25 percent of the first year's registration 2 25 fee or $35, whichever is higher. The bill also makes 2 26 coordinating repeals of sections 328.22 and 328.24. 2 27 LSB 1588HH 77 2 28 mk/cf/24
