1 1 Section 1. Section 455B.103A, subsection 1, Code 1997, is
1 2 amended by adding the following new paragraph:
1 3 NEW PARAGRAPH. h. Before final approval is given under
1 4 this section for a general permit to discharge stormwater, the
1 5 department shall obtain the services of a local representative
1 6 of the United States natural resource conservation service to
1 7 conduct an impact study of soil erosion and sediment
1 8 accumulation at the point of the stormwater discharge. The
1 9 impact study shall be completed at least thirty days before
1 10 final approval of the general permit. The findings of the
1 11 impact study shall be made available to the owners of the land
1 12 adjacent to the point of stormwater discharge. If the impact
1 13 study is not completed and available to the public as provided
1 14 in this paragraph, a general permit shall not be issued.
1 15 EXPLANATION
1 16 This bill provides that, before the department of natural
1 17 resources issues a general permit for stormwater discharge,
1 18 the department shall obtain the services of the United States
1 19 natural resource conservation service to conduct an impact
1 20 study of soil erosion and sediment accumulation at the point
1 21 of the stormwater discharge. The impact study shall be
1 22 completed at least 30 days before the general permit is
1 23 approved. The findings of the impact study are to be made
1 24 available to the owners of land adjacent to the point of the
1 25 discharge. If the impact study is not completed, a general
1 26 permit shall not be issued.
