PAG LIN 1 1 Section 1. Section 321.384, subsection 1, Code 1997, is 1 2 amended to read as follows: 1 3 1.EveryA motor vehicle operated upon a highway within 1 4thethis state,shall display lighted headlamps as provided in 1 5 section 321.415 at any time from sunset to sunrise, at any 1 6 time when the windshield wipers are in continuous operation, 1 7 and at such other times when conditions such as fog, snow, 1 8 sleet, or rain provide insufficient lighting to render clearly 1 9 discernible persons and vehicles on the highway at a distance 1 10 of five hundred feet ahead,shall display lighted head lamps1 11as provided in section 321.415,subject to exceptions with 1 12 respect to parked vehicles as hereinafter stated. 1 13 Sec. 2. WARNING CITATIONS. During the first six months 1 14 following enactment of this Act, peace officers shall issue 1 15 only warning citations for motor vehicles not displaying 1 16 lighted headlamps at any time when the windshield wipers are 1 17 in continuous operation as required by section 321.384, 1 18 subsection 1, as amended in this Act. 1 19 EXPLANATION 1 20 This bill requires that a motor vehicle must display 1 21 lighted headlights at any time when the vehicle's windshield 1 22 wipers are in continuous operation. A violation of this 1 23 provision carries a scheduled fine of $20. The bill also 1 24 provides that during the first six months following enactment, 1 25 violations of this bill will only result in warning citations. 1 26 LSB 1234HH 77 1 27 mk/sc/14
