PAG LIN 1 1 HOUSE CONCURRENT RESOLUTION NO. ___ 1 2 BY TYRRELL 1 3 (COMPANION TO LSB 4413SS BY DRAKE) 1 4 A Concurrent Resolution urging federal Congressional 1 5 support for widows and widowers under the federal 1 6 Railroad Retirement Act of 1974. 1 7 WHEREAS, a Concurrent Resolution has been 1 8 introduced in the United States House of 1 9 Representatives to encourage the United States 1 10 Railroad Retirement Board to modify the guaranteed 1 11 minimum benefit for widows and widowers to provide 1 12 adequate annuities; and 1 13 WHEREAS, for years, many in the railroad industry 1 14 have argued that annuities paid to widows and widowers 1 15 under the federal Railroad Retirement Act of 1974 are 1 16 inadequate; and 1 17 WHEREAS, during the lifetime of a railroad employee 1 18 and the employee's spouse, the employee receives a 1 19 full annuity and so does the spouse; and 1 20 WHEREAS, however, after the employee's death, only 1 21 a widow's or widower's annuity is payable, which under 1 22 current law is no less than that widow or widower 1 23 received as a spouse in the month before the 1 24 employee's death; and 1 25 WHEREAS, the widow's or widower's annuity is often 1 26 found inadequate and leaves the survivor with less 1 27 than the amount of income needed to meet ordinary and 1 28 necessary living expenses; and 1 29 WHEREAS, no outside contributions from taxpayers 1 30 are needed, and any changes will be paid for from 2 1 within the railroad industry itself, including a full 2 2 share by active employees; NOW THEREFORE, 2 3 BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES, THE 2 4 SENATE CONCURRING, That the General Assembly urges the 2 5 United States Congress to support U.S. House of 2 6 Representatives Concurrent Resolution 52 that calls 2 7 for the Congress of the United States to recognize the 2 8 concern of many in the railroad industry that the 2 9 spousal annuity under the current system is inadequate 2 10 and often leaves the survivor with less than the 2 11 amount of income needed to meet ordinary and necessary 2 12 living expenses and that a process of dialogue must 2 13 take place among all parties of the railroad 2 14 community, including rail labor, management, and 2 15 retiree organizations, before railroad annuity 2 16 legislation can be enacted; and 2 17 BE IT FURTHER RESOLVED, That the General Assembly 2 18 supports adoption of the federal Congressional 2 19 resolution which urges and exhorts all parties of the 2 20 railroad community, including rail labor, management, 2 21 and retiree organizations, to find a suitable way to 2 22 fund an amendment that would improve the survivor 2 23 benefits component to the Railroad Retirement Act of 2 24 1974; and 2 25 BE IT FURTHER RESOLVED, That copies of this 2 26 Resolution be sent by the Chief Clerk of the House of 2 27 Representatives to the President of the United States, 2 28 the President of the United States Senate, the Speaker 2 29 of the United States House of Representatives, all 2 30 members of the Iowa Congressional delegation, and the 3 1 members of the United States Railroad Retirement 3 2 Board. 3 3 LSB 4413HH 77 3 4 ec/jl/8
