  1  1    Amend the Senate amendment, H-9118, to House File
  1  2 2498, as amended passed, and reprinted by the House,
  1  3 as follows:
  1  4    #1.  Page 4, by inserting after line 10 the
  1  5 following:
  1  6    "#   .  Page 24, by inserting after line 3 the
  1  7 following:
  1  8    "Sec. 201.  Section 25B.5A, Code 1997, as amended
  1  9 by 1998 Iowa Acts, House File 8, section 3, is amended
  1 10 by adding the following new subsection:
  1 11    NEW SUBSECTION.  3.  Notwithstanding subsection 1,
  1 12 if, on or after July 1, 1998, a state mandate relating
  1 13 to the enforcement of chapter 321J or the Iowa
  1 14 criminal code pursuant to chapters 701 to 728 is
  1 15 enacted by the general assembly, or otherwise imposed,
  1 16 on a political subdivision and the state mandate
  1 17 requires a political subdivision to engage in any new
  1 18 activity, to provide any new service, or to provide
  1 19 any service beyond that required by any law enacted
  1 20 prior to July 1, 1998, and the state does not
  1 21 appropriate moneys to fully fund the cost of the state
  1 22 mandate, the political subdivision is not required to
  1 23 perform the activity or provide the service and the
  1 24 political subdivision shall not be subject to the
  1 25 imposition of any fines or penalties for the failure
  1 26 to comply with the state mandate unless the
  1 27 legislation specifies the amount or proportion of the
  1 28 cost of the state mandate which the state shall pay
  1 29 annually.
  1 30    Sec.    .  APPLICABILITY.  If 1998 Iowa Acts, House
  1 31 File 8, is not enacted by the general assembly,
  1 32 section 201 of this Act is void.""
