1 2 #1. Page 1, by inserting before line 1 the
1 3 following:
1 4 "Section 100. Section 403.5, Code 1997, is amended
1 5 by adding the following new subsection:
1 6 NEW SUBSECTION. 8. An economic development area
1 7 shall not include agricultural land located within an
1 8 agricultural area designated pursuant to section
1 9 352.7. If all or a portion of an agricultural area is
1 10 located within an economic development area as of July
1 11 1, 1998, the governing body of the economic
1 12 development area shall amend the urban renewal plan to
1 13 sever that portion of such agricultural area which
1 14 contains agricultural land. The plan shall be amended
1 15 to sever the agricultural land without regard to when
1 16 the agricultural area or the economic development area
1 17 was established.
1 18 For purposes of this subsection, "agricultural
1 19 land" means real property that is used for the
1 20 production of agricultural commodities including, but
1 21 not limited to, the raising, harvesting, handling,
1 22 drying, or storage of crops used for feed, food, seed,
1 23 or fiber; the care or feeding of livestock; the
1 24 handling or transportation of crops or livestock; the
1 25 storage, treatment, or disposal of livestock manure;
1 26 and the application of fertilizers, soil conditioners,
1 27 pesticides, and herbicides on crops."
1 28 #2. Page 1, by inserting after line 23 the
1 29 following:
1 30 "Sec. 101. APPLICABILITY. Section 100 of this Act
1 31 applies to urban renewal areas established before, on,
1 32 or after the effective date of this Act."
1 33 #3. Title page, line 1, by inserting after the
1 34 word "areas" the following: "and to certain property
1 35 located within an urban renewal area and providing
1 36 retroactive applicability".
1 37 #4. By renumbering as necessary.
