  1  1    Amend Senate Joint Resolution 2004, as passed by
  1  2 the Senate, as follows:
  1  3    #1.  Page 4, by inserting after line 11 the
  1  4 following:
  1  5    "Sec. 3.  The following amendment to the
  1  6 Constitution of the State of Iowa is proposed:
  1  7    The Constitution of the State of Iowa is amended by
  1  8 adding the following new section to new Article XIII:
  1  9    PROHIBITION ON STATE MANDATES.  Section 1.  If a
  1 10 state mandate is enacted by the General Assembly, or
  1 11 otherwise imposed on a political subdivision and the
  1 12 state mandate requires a political subdivision to
  1 13 engage in any new activity, to provide any new
  1 14 service, or to provide any service beyond that
  1 15 required by any law, and the state does not
  1 16 appropriate moneys to fully fund the cost of the state
  1 17 mandate, the political subdivision is not required to
  1 18 perform the activity or provide the service and the
  1 19 political subdivision shall not be subject to the
  1 20 imposition of any fines or penalties for the failure
  1 21 to comply with the state mandate.  For the purposes of
  1 22 this section, any requirement originating from the
  1 23 federal government and administered, implemented, or
  1 24 enacted by the state, and any allocation of federal
  1 25 moneys conditioned upon enactment of a state law or
  1 26 rule, are not state mandates.
  1 27    The prohibition in this section does not apply if
  1 28 the bill containing the state mandate passes by the
  1 29 affirmative votes of at least three-fifths of the
  1 30 whole membership of each house of the General
  1 31 Assembly."
