1 1 Amend Senate Joint Resolution 2004, as passed by
1 2 the Senate, as follows:
1 3 #1. Page 2, line 20, by inserting before the word
1 4 "Any" the following: "a."
1 5 #2. Page 2, by striking lines 22 and 23 and
1 6 inserting the following: "fiscal year shall be
1 7 deposited into the property tax relief fund. Any
1 8 surplus equal to ten".
1 9 #3. Page 2, by inserting after line 32 the
1 10 following:
1 11 "b. The property tax relief fund is created. The
1 12 fund shall be separate from the general fund of the
1 13 state and the balance in the fund shall not be
1 14 considered part of the balance of the general fund of
1 15 the state. The moneys in the fund shall not revert to
1 16 the general fund of the state or any other fund. The
1 17 maximum balance of the property tax relief fund equals
1 18 five percent of the adjusted revenue estimate for the
1 19 fiscal year. Any money in excess of the maximum
1 20 balance shall be transferred to the general fund and
1 21 be included in the adjusted revenue estimate for the
1 22 following fiscal year. The moneys in the property tax
1 23 relief fund shall only be appropriated by the General
1 24 Assembly for reducing overall state or local taxes of
1 25 the state. Interest or earnings on moneys deposited
1 26 in the property tax relief fund shall be credited to
1 27 the property tax relief fund."
