1 3 #1. Page 82, by inserting after line 2, the
1 4 following:
1 5 "Sec. ___. NEW SECTION. 514I.10. HAWK-I TRUST
1 6 FUND.
1 7 1. A HAWK-I trust fund is created in the state
1 8 treasury under the authority of the department of
1 9 human services, to which all state appropriations
1 10 shall be deposited and used to carry out the purposes
1 11 of this chapter. Other revenues of the program such
1 12 as grants, contributions, and participant payments
1 13 shall not be considered revenue of the state, but
1 14 rather shall be funds of the program.
1 15 2. The trust fund shall be separate from the
1 16 general fund of the state and shall not be considered
1 17 part of the general fund of the state. The moneys in
1 18 the trust fund are not subject to section 8.33 and
1 19 shall not be transferred, used, obligated,
1 20 appropriated, or otherwise encumbered except as
1 21 provided in this chapter. Notwithstanding section
1 22 12C.7, subsection 2, interest or earnings on moneys
1 23 deposited in the trust fund shall be credited to the
1 24 trust fund."
