  1  1    Amend the Senate amendment, H-8832, to House File
  1  2 2528, as amended, passed, and reprinted by the House,
  1  3 as follows:
  1  4    #1.  Page 1, by inserting after line 4 the
  1  5 following:
  1  6    "#   .  Page 3, by inserting after line 8 the
  1  7 following:
  1  8    "Sec. ___.  NEW SECTION.  321.178A  DRIVER
  1  9 EDUCATION – TEACHING PARENT.
  1 10    1.  TEACHING PARENT QUALIFICATIONS.  As an
  1 11 alternative to section 321.178, a teaching parent may
  1 12 instruct a student in driver's education courses which
  1 13 meet the requirements of this section, and provides
  1 14 certified evidence that the requirements under this
  1 15 section have been met.
  1 16    2.  DEFINITIONS.  For purposes of this section:
  1 17    a.  "Student" means a person within the custody and
  1 18 control of the teaching parent, who is between the
  1 19 ages of fourteen and twenty-one years of age and who
  1 20 satisfies preliminary licensing requirements of the
  1 21 department.
  1 22    b.  "Teaching parent" means a person who is the
  1 23 parent or guardian of a student, who holds a current
  1 24 valid Iowa license to operate a motor vehicle, and who
  1 25 is either a person providing competent instruction or
  1 26 competent private instruction pursuant to section
  1 27 299A.2 or 299A.3.
  1 28    3.  COURSE OF INSTRUCTION.  A driver education
  1 29 course administered by a teaching parent shall consist
  1 30 at a minimum of the following:
  1 31    a.  Thirty clock hours of classroom instruction.
  1 32    b.  Forty hours of street or highway driving
  1 33 including four hours of driving after sunset and
  1 34 before sunrise while accompanied by a parent or
  1 35 guardian.
  1 36    c.  Four hours of classroom instruction concerning
  1 37 substance abuse.
  1 38    d.  A minimum of twenty minute of instruction
  1 39 concerning railroad crossing safety.
  1 40    e.  Instruction relating to becoming an organ donor
  1 41 under the uniform anatomical gift Act.
  1 42    The content of the course of instruction required
  1 43 under this subsection shall be equivalent to that
  1 44 required under section 321.178.  However, the course
  1 45 requirements, reference and study materials, manuals,
  1 46 study aids, workbooks, physical requirements,
  1 47 classroom dimensions, type of chalkboards, extra
  1 48 vehicle safety equipment, extra foot brake, cut-off
  1 49 switches, and extra mirrors required for instruction
  1 50 under section 321.178 shall not be required for the
  2  1 course of instruction provided under this section.
  2  2    4.  COURSE COMPLETION AND CERTIFICATION.  Upon
  2  3 completion of a course under this section, the
  2  4 teaching parent shall document or provide evidence
  2  5 showing substantial statutory compliance with the
  2  6 requirements of subsection 3 and certify by affidavit
  2  7 to the department of education that the course has
  2  8 been completed.  Documentation shall include the
  2  9 following:
  2 10    a.  An affidavit attesting to satisfactory
  2 11 completion of course work and street or highway
  2 12 driving instruction.
  2 13    b.  A listing of subjects presented in classroom
  2 14 training.
  2 15    c.  Copies of written tests completed by the
  2 16 student.
  2 17    d.  A statement of the number of classroom hours of
  2 18 instruction.
  2 19    e.  A log of street or highway driving instruction
  2 20 including the dates when the lessons were conducted,
  2 21 the student's and the parent's name and initials noted
  2 22 next to each entry, notes on driving activities,
  2 23 including a list of driving deficiencies and
  2 24 improvements, and the duration of the driving time for
  2 25 each session.  If the department of education is
  2 26 satisfied that the course has been completed in
  2 27 accordance with this section, the department shall
  2 28 certify it as an approved driver's education course.
  2 29    5.  INTERMEDIATE LICENSE.  Any student who
  2 30 successfully completes an approved driver education
  2 31 course as provided in this section and who passes a
  2 32 driving field test to be administered by the
  2 33 department and is otherwise qualified under section
  2 34 321.180B, subsection 2, shall be eligible for an
  2 35 intermediate license pursuant to section 321.180B.
  2 36 Such a student is not required to file an affidavit
  2 37 with the department regarding completion of street or
  2 38 highway driving with a parent or guardian under
  2 39 section 321.180B, subsection 2, and the hours of
  2 40 driving required under subsection 3 shall substitute
  2 41 for any hours of driving required under section
  2 42 321.180B, subsection 2.
  2 43    6.  FULL LICENSE.  A student must comply with
  2 44 section 321.180B, subsection 4, to be eligible for a
  2 45 full driver's license pursuant to section 321.180B.""
