1 5 "(2) Issue a citation to the driver. If a
1 6 citation is issued, the citation shall be issued under
1 7 this subparagraph unless the driver has been
1 8 previously charged and cited for a violation of
1 9 subsection 1. A citation which is issued and
1 10 subsequently dismissed shall be disregarded for
1 11 purposes of determining if the driver has been
1 12 previously charged and cited."
