PAG LIN 1 1 Amend the amendment, H-8701, to House File 2533 as 1 2 follows: 1 3 #1. Page 1, by inserting after line 1 the 1 4 following: 1 5 "# . Page 26, by inserting after line 3 the 1 6 following: 1 7 "Sec. ___. Section 125.7, Code 1997, is amended by 1 8 adding the following new subsection: 1 9 NEW SUBSECTION. 8. By July 1, 1999, adopt a 1 10 written policy under which the Iowa board of substance 1 11 abuse certification in the substance abuse and health 1 12 promotion division of the department of public health 1 13 shall carry out drug testing of applicants for 1 14 certification, or renewal of certification, as a 1 15 prevention specialist. The written policy shall be 1 16 provided to an applicant prior to drug testing carried 1 17 out in accordance with this subsection. The 1 18 commission shall require applicants to submit to a 1 19 test for the presence of drugs, as defined in section 1 20 730.5, prior to receiving certification or renewal of 1 21 certification as a prevention specialist. A positive 1 22 result on the drug test makes the applicant ineligible 1 23 for certification or renewal under this subsection. 1 24 Applicants shall be provided an opportunity to provide 1 25 any information that may be considered relevant to the 1 26 test, including identification of prescription or 1 27 nonprescription drugs currently or recently used, or 1 28 other relevant medical information. To assist an 1 29 applicant in providing the information described in 1 30 this subsection, the Iowa board of substance abuse 1 31 certification shall provide an applicant with a list 1 32 of the drugs to be tested. Drug testing shall include 1 33 confirmation of any initial positive test results. 1 34 For drug testing, confirmation shall be by use of a 1 35 different chemical process than was used in the 1 36 initial screen for drugs. The confirmatory drug test 1 37 shall be a chromatographic technique such as gas 1 38 chromatography or mass spectrometry, or another 1 39 comparably reliable analytical method. 1 40 All communications received by the Iowa board of 1 41 substance abuse certification relevant to an 1 42 applicant's drug test results, or otherwise received 1 43 through the drug testing program, are confidential 1 44 communications and shall not be used or received in 1 45 evidence, obtained in discovery, or disclosed in any 1 46 public or private proceeding, except as otherwise 1 47 provided or authorized by this subsection. An 1 48 applicant who is the subject of a drug test conducted 1 49 under this subsection and for whom a confirmed 1 50 positive test result is reported, shall, upon written 2 1 request, have access to any records relating to the 2 2 applicant's drug test, including records of the 2 3 laboratory where the testing was conducted and any 2 4 records relating to the results of any relevant 2 5 certification or review by a medical review officer. 2 6 Except as necessary to conduct drug testing under this 2 7 subsection and to file a report, a laboratory and a 2 8 medical review officer conducting drug testing under 2 9 this subsection shall not use or disclose to any 2 10 person any personally identifiable information 2 11 regarding such testing, including the names of 2 12 individuals tested, even if unaccompanied by the 2 13 results of the test." 2 14 #2.
