1 1 Amend the amendment, H-8354, to House File 2494, as
1 2 follows:
1 3 #1. Page 2, by striking lines 13 through 16, and
1 4 inserting the following:
1 5 "# . Page 21, by striking lines 11 through 14,
1 6 and inserting the following: "permit. All of the
1 7 following shall apply:
1 8 a. A completed application for which the
1 9 department has not taken final agency action by
1 10 approval or disapproval within the sixty-day period
1 11 shall be approved by default. The sixty-day
1 12 requirement shall not apply to an application if the
1 13 applicant is not required to obtain a permit in order
1 14 to construct an animal feeding operation structure or
1 15 to operate an animal feeding operation.
1 16 b. Judicial review of a final agency action for
1 17 the approval or disapproval of a permit shall be de
1 18 novo, regardless of whether an approval was
1 19 affirmatively made by the department or by default,
1 20 including judicial review of a contested case in which
1 21 the county board of supervisors is a party as provided
1 22 in this section.""
