1 2 #1. Page 35, by inserting after line 24 the
1 3 following:
1 4 "Sec. . NEW SECTION. 455B.205A ENVIRONMENTAL
1 5 HEALTH SPECIALISTS.
1 6 1. The department shall contract with local boards
1 7 of health serving a county or district as provided in
1 8 chapter 137 in order to carry out this section. The
1 9 department shall enter into a contract with a local
1 10 board of health, if the agreement for the services is
1 11 cost-effective and the quality of the services
1 12 provided ensures compliance with requirements of this
1 13 chapter, including rules adopted by the department.
1 14 If a local board of health is acting in a manner that
1 15 is inconsistent with the provisions of this chapter or
1 16 the contract, the department may revoke the contract.
1 17 2. A local board of health which is a party to a
1 18 contract with the department shall designate
1 19 environmental health specialists who shall monitor
1 20 confinement feeding operations and the application of
1 21 manure on land within the board's jurisdiction,
1 22 according to procedures consistent with departmental
1 23 requirements. In conducting monitoring operations,
1 24 the environmental health specialists shall do all of
1 25 the following:
1 26 a. Ensure compliance with manure management plans
1 27 as provided in section 455B.203.
1 28 b. Inspect unformed manure storage structures. An
1 29 inspection shall include a visual determination
1 30 regarding a structure's freeboard level, seepage of
1 31 manure from the structure, erosion, adequate
1 32 vegetation cover, and the presence of an opening
1 33 allowing manure to drain from the structure.
1 34 c. Test drinking water wells which may be
1 35 contaminated by animal feeding operation structures.
1 36 3. An environmental health specialist shall be
1 37 deemed to be an agent of the department for the
1 38 purpose of carrying out duties under the contract,
1 39 including the inspection of premises. An
1 40 environmental health specialist shall have the same
1 41 authority under this chapter provided to the
1 42 department, unless the contract specifies otherwise.
1 43 In order to conduct monitoring, the environmental
1 44 health specialist must comply with standard
1 45 biosecurity requirements customarily required by the
1 46 confinement feeding operation."
