  1  1    Amend the amendment, H-8054, to House File 681 as
  1  2 follows:
  1  3    #1.  Page 4, by inserting after line 39 the
  1  4 following:
  1  5    "d.  The court determines that the inquiring
  1  6 party's need for the portion of the environmental
  1  7 audit report outweighs the interest of the owner or
  1  8 operator in protecting its evaluation process.  In so
  1  9 determining, the court shall weigh the relevance of
  1 10 the evidence sought to be protected, the availability
  1 11 of other evidence, the seriousness of the litigation
  1 12 and the issues involved, the role of the government in
  1 13 the litigation, and the adverse impact on the owner's
  1 14 or operator's reasonable expectations of
  1 15 confidentiality in the information sought to be
  1 16 disclosed."
  1 17    #2.  By renumbering as necessary.
