  1  1    Amend Senate File 316, as passed by the Senate, as
  1  2 follows:
  1  3    #1.  Page 1, line 16, by striking the word "six"
  1  4 and inserting the following:  "up to nine".
  1  5    #2.  Page 1, line 23, by striking the word "six"
  1  6 and inserting the following:  "up to nine".
  1  7    #3.  Page 1, line 29, by inserting after the word
  1  8 "commission." the following:  "Each deputy sheriff who
  1  9 transfers from one jurisdiction to another shall be
  1 10 employed subject to a probationary period of up to
  1 11 nine months."
  1 12    #4.  Page 1, by inserting after line 33 the
  1 13 following:
  1 14    "Sec. ___.  Section 400.8, subsection 3, Code 1997,
  1 15 is amended to read as follows:
  1 16    3.  All appointments to such positions shall be
  1 17 conditional upon a probation period of not to exceed
  1 18 six months, and in the case of police patrol officers,
  1 19 police dispatchers, and fire fighters a probation
  1 20 period not to exceed twelve months.  In the case of
  1 21 police patrol officers, if the employee has
  1 22 successfully completed training at the Iowa law
  1 23 enforcement academy or another training facility
  1 24 certified by the director of the Iowa law enforcement
  1 25 academy before the initial appointment as a police
  1 26 patrol officer, the probationary period shall be for a
  1 27 period of up to nine months and shall commence with
  1 28 the date of initial appointment as a police patrol
  1 29 officer.  If the employee has not successfully
  1 30 completed training at the Iowa law enforcement academy
  1 31 or another training facility certified by the director
  1 32 of the law enforcement academy before initial
  1 33 appointment as a police patrol officer, the
  1 34 probationary period shall commence with the date of
  1 35 initial employment as a police patrol officer and
  1 36 shall continue for a period of up to nine months
  1 37 following the date of successful completion of
  1 38 training at the Iowa law enforcement academy or
  1 39 another training facility certified by the director of
  1 40 the Iowa law enforcement academy.  A police patrol
  1 41 officer transferring employment from one jurisdiction
  1 42 to another shall be employed subject to a probationary
  1 43 period of up to nine months.  However, in cities with
  1 44 a population over one hundred seventy-five thousand,
  1 45 appointments to the position of fire fighter shall be
  1 46 conditional upon a probation period of not to exceed
  1 47 twenty-four months.  During the probation period, the
  1 48 appointee may be removed or discharged from such
  1 49 position by the appointing person or body without the
  1 50 right of appeal to the commission.  A person removed
  2  1 or discharged during a probationary period shall, at
  2  2 the time of discharge, be given a notice in writing
  2  3 stating the reason or reasons for the dismissal.  A
  2  4 copy of such notice shall be promptly filed with the
  2  5 commission.  Continuance in the position after the
  2  6 expiration of such probationary period shall
  2  7 constitute a permanent appointment."
