  1  4 RELATING TO THE TRAINING AND PROBATIONARY PERIODS FOR CERTAIN
  1  5    LAW ENFORCEMENT OFFICERS.

  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 
  1  8 
  1  9    Section 1.  NEW SECTION.  80B.17  CERTIFICATION REQUIRED.
  1 10    The council shall extend the one-year time period in which
  1 11 an officer candidate must become certified for up to one
  1 12 hundred eighty days if the officer candidate is enrolled in
  1 13 training within twelve months of initial appointment.
  1 14    Sec. 2.  Section 341A.11, unnumbered paragraph 1, Code
  1 15 1997, is amended to read as follows:
  1 16    The tenure of every deputy sheriff holding an office or
  1 17 position of employment under the provisions of this chapter
  1 18 shall be conditional upon a probationary period of not more
  1 19 than twelve months, and where such deputy sheriff attends the
  1 20 law enforcement academy or a regional training facility
  1 21 certified by the director of the Iowa law enforcement academy,
  1 22 a probationary period of not more than six months, during
  1 23 which time the appointee may be removed or discharged by the
  1 24 sheriff.  Thereafter If the employee has successfully
  1 25 completed training at the Iowa law enforcement academy or a
  1 26 regional training facility certified by the director of the
  1 27 Iowa law enforcement academy prior to initial appointment as a
  1 28 deputy sheriff, the probationary period shall be for a period
  1 29 of up to nine months and shall commence with the date of
  1 30 initial appointment as a deputy sheriff.  If the employee has
  1 31 not successfully completed training at the Iowa law
  1 32 enforcement academy or a regional training facility certified
  1 33 by the director of the Iowa law enforcement academy prior to
  1 34 initial appointment as a deputy sheriff, the probationary
  1 35 period shall commence with the date of initial employment as a
  2  1 deputy sheriff and shall continue for a period of up to nine
  2  2 months following the date of successful completion of training
  2  3 at the Iowa law enforcement academy or a regional training
  2  4 facility certified by the director of the Iowa law enforcement
  2  5 academy.  During the probationary period, the appointee may be
  2  6 removed or discharged by the sheriff without the right of
  2  7 appeal to the commission.  Each deputy sheriff who transfers
  2  8 from one jurisdiction to another shall be employed subject to
  2  9 a probationary period of up to nine months.  After the
  2 10 probationary period, the deputy sheriff may be removed or
  2 11 discharged, suspended without pay, demoted, or reduced in
  2 12 rank, or deprived of vacation privileges or other privileges
  2 13 for any of the following reasons:
  2 14    Sec. 3.  Section 400.8, subsection 3, Code 1997, is amended
  2 15 to read as follows:
  2 16    3.  All appointments to such positions shall be conditional
  2 17 upon a probation period of not to exceed six months, and in
  2 18 the case of police patrol officers, police dispatchers, and
  2 19 fire fighters a probation period not to exceed twelve months.
  2 20 In the case of police patrol officers, if the employee has
  2 21 successfully completed training at the Iowa law enforcement
  2 22 academy or another training facility certified by the director
  2 23 of the Iowa law enforcement academy before the initial
  2 24 appointment as a police patrol officer, the probationary
  2 25 period shall be for a period of up to nine months and shall
  2 26 commence with the date of initial appointment as a police
  2 27 patrol officer.  If the employee has not successfully
  2 28 completed training at the Iowa law enforcement academy or
  2 29 another training facility certified by the director of the law
  2 30 enforcement academy before initial appointment as a police
  2 31 patrol officer, the probationary period shall commence with
  2 32 the date of initial employment as a police patrol officer and
  2 33 shall continue for a period of up to nine months following the
  2 34 date of successful completion of training at the Iowa law
  2 35 enforcement academy or another training facility certified by
  3  1 the director of the Iowa law enforcement academy.  A police
  3  2 patrol officer transferring employment from one jurisdiction
  3  3 to another shall be employed subject to a probationary period
  3  4 of up to nine months.  However, in cities with a population
  3  5 over one hundred seventy-five thousand, appointments to the
  3  6 position of fire fighter shall be conditional upon a probation
  3  7 period of not to exceed twenty-four months.  During the
  3  8 probation period, the appointee may be removed or discharged
  3  9 from such position by the appointing person or body without
  3 10 the right of appeal to the commission.  A person removed or
  3 11 discharged during a probationary period shall, at the time of
  3 12 discharge, be given a notice in writing stating the reason or
  3 13 reasons for the dismissal.  A copy of such notice shall be
  3 14 promptly filed with the commission.  Continuance in the
  3 15 position after the expiration of such probationary period
  3 16 shall constitute a permanent appointment.
