  1  1    Amend Senate File 523, as amended, passed, and
  1  2 reprinted by the Senate, as follows:
  1  3    #1.  Page 2, by inserting after line 33 the
  1  4 following:
  1  5    "5.  If a facility or employer employs an
  1  6 individual in good faith and with reasonable reliance
  1  7 upon the report of the criminal and dependent adult
  1  8 abuse record checks requested under this section, the
  1  9 facility or employer shall not be liable in a tort or
  1 10 other civil action for damages brought as the result
  1 11 of injury, death, or loss to a person or property
  1 12 caused by the individual while the individual is
  1 13 employed in a facility solely because of the facility
  1 14 or employer's reliance upon the record check report,
  1 15 even if the information in the report is determined
  1 16 later to be incomplete or inaccurate."
