1 2 #1. Page 19, by inserting after line 11 the
1 3 following:
1 4 "Sec. . Section 455B.171, Code 1997, is amended
1 5 by adding the following new subsection:
1 6 NEW SUBSECTION. 1A. "Agricultural drainage well"
1 7 means a vertical opening to an aquifer or permeable
1 8 substratum which is constructed by any means
1 9 including, but not limited to, drilling, driving,
1 10 digging, boring, augering, jetting, washing, or
1 11 coring, and which is capable of intercepting or
1 12 receiving surface or subsurface drainage water from
1 13 land directly or by a drainage system.
1 14 Sec. . Section 455B.201, subsection 4, Code
1 15 1997, is amended to read as follows:
1 16 4. A person shall not use spray irrigation
1 17 equipment to apply manure on land from which water
1 18 drains into an agricultural drainage well. A person
1 19 shall not otherwise apply manure by spray irrigation
1 20 equipment, except as provided by rules which shall be
1 21 adopted by the department pursuant to chapter 17A."
