1 2 #1. Page 12, by inserting after line 4 the
1 3 following:
1 4 "___. To the department of natural resources for
1 5 testing exclusively earthen manure storage structures,
1 6 in accordance with this subsection:
1 7 .................................................. $ 100,000
1 8 a. The department shall utilize the moneys
1 9 appropriated in this subsection to perform testing of
1 10 exclusively earthen manure storage structures,
1 11 including anaerobic lagoons and earthen manure storage
1 12 basins, which are part of confinement feeding
1 13 operations.
1 14 b. The testing shall include installation and
1 15 operation of hydrological monitoring wells. The
1 16 testing process shall be considered as part of an
1 17 inspection. The department shall comply with section
1 18 455B.103 when entering upon land to perform testing
1 19 under this section, unless the owner of the
1 20 confinement feeding operation agrees to the
1 21 inspection. The owner of a confinement feeding
1 22 operation who obstructs or interferes with testing
1 23 shall be subject to a civil penalty of not more than
1 24 five thousand dollars.
1 25 c. The department shall report its findings and
1 26 recommendations to the general assembly. A
1 27 preliminary report shall be submitted on or before
1 28 January 1, 1998, and a final report shall be delivered
1 29 on or before January 1, 1999.
1 30 d. Notwithstanding section 8.33, moneys
1 31 appropriated pursuant to this subsection shall not
1 32 revert until January 15, 1999.
1 33 e. Chapter 22 shall apply to all information
1 34 received by the department other than information
1 35 which identifies a person or operation subject to the
1 36 testing, unless an administrative or legal action is
1 37 brought to enforce a violation of chapter 455B as
1 38 provided in that chapter."
