  1  1    Amend the amendment, H-1481, to House File 693 as
  1  2 follows:
  1  3    #1.  Page 1, line 30, by inserting after the word
  1  4 "birthday." the following:  "A physician and surgeon,
  1  5 osteopath, osteopathic physician and surgeon, dentist,
  1  6 podiatric physician, optometrist, pharmacist,
  1  7 chiropractor, physician assistant, or nurse licensed
  1  8 under chapter 147, or a hospital licensed under
  1  9 chapter 135B shall not assert this paragraph as a
  1 10 defense unless an informed consent waiver which was
  1 11 signed by the patient's parent or legal guardian prior
  1 12 to the treatment in question is produced.  The
  1 13 informed consent waiver shall state:
  1 14    I am aware that any claim for damages arising from
  1 15 any injury to or the death of my child, or the child
  1 16 for whom I am the legal guardian, due to the treatment
  1 17 the child is about to receive must be filed no later
  1 18 than the child's eighth birthday, as the child will be
  1 19 under the age of six when the treatment is performed.
  1 20 I understand that this means my family will forever
  1 21 forfeit any right to recover damages arising from this
  1 22 treatment unless a claim is filed prior to the child's
  1 23 eighth birthday, even if such treatment results in
  1 24 injuries that are not discovered until after the
  1 25 child's eighth birthday."
