1 5 party seeking to avail themselves of the benefit of
1 6 this subsection proves by a preponderance of the
1 7 evidence that, at the time the product was first
1 8 placed in the stream of commerce, it contained the
1 9 following disclaimer:
1 10 This product was delivered on _______________ (date
1 11 and time of delivery) and has an expected useful life
1 12 of _____ (expected useful life of product, in years)
1 13 years. Anyone purchasing or using this product should
1 14 not anticipate that this product will be free from
1 15 defects after ______________ (last date of the
1 16 product's useful life). Furthermore, anyone
1 17 purchasing or using this product after
1 18 ________________ (last date of the product's useful
1 19 life) should be aware that they may not have any legal
1 20 recourse available to them in the event this product
1 21 causes an injury or death. It is important that you
1 22 retain this disclaimer as it is the only warning you
1 23 shall receive relating to the useful life of this
1 24 product."
