1 2 #1. Page 7, line 6, by inserting after the word
1 3 "operations." the following: "As a condition of this
1 4 allocation, the department shall adopt rules as
1 5 necessary to provide that manure from the site of an
1 6 animal feeding operation does not enter into a
1 7 drainage system. The rules shall prohibit a person
1 8 from constructing or expanding an earthen manure
1 9 storage basin used in conjunction with a confinement
1 10 feeding operation in which swine are confined, if the
1 11 earthen manure storage basin as constructed or
1 12 expanded would have a capacity to store more than two
1 13 million gallons of waste discharge. The rules shall
1 14 provide for inspecting the site of an anaerobic lagoon
1 15 or earthen manure storage basin, examining records of
1 16 known drainage tiles serving the site, and removing,
1 17 rerouting, capping, or plugging tile lines near the
1 18 site. The rules shall apply regardless of the date
1 19 that the anaerobic lagoon or earthen manure storage
1 20 basin was constructed."
