1 2 #1. Page 7, line 6, by inserting after the word
1 3 "operations." the following: "As a condition of this
1 4 allocation, the department of natural resources shall
1 5 maintain an active program to monitor anaerobic
1 6 lagoons and earthen manure storage basins which are
1 7 part of animal feeding operations, and especially
1 8 structures which have been constructed before July 1,
1 9 1985, or which are located within environmentally
1 10 sensitive areas, including but not limited to
1 11 agricultural drainage well basins or drainage
1 12 districts where agricultural drainage wells are
1 13 located. The department may install and operate a
1 14 hydrological monitoring system if after an on-site
1 15 inspection, the department determines that the site
1 16 presents an extraordinary potential for surface water
1 17 or subsurface water pollution. The department shall
1 18 file a report with the general assembly on or before
1 19 January 15 describing the department's monitoring
1 20 activities, including resulting disciplinary or legal
1 21 action initiated by the department or the attorney
1 22 general against animal feeding operations in violation
1 23 of chapter 455B."
