1 8 #3. Page 5, by inserting before line 32 the
1 9 following:
1 10 "Sec. ___. Section 9H.5, Code 1997, is amended by
1 11 adding the following new subsection:
1 12 NEW SUBSECTION. 2A. An authorized entity shall
1 13 not directly or indirectly own, control, or contract
1 14 for the care and feeding of animals having an animal
1 15 weight capacity of six hundred twenty-five thousand
1 16 pounds or more for animals other than bovine or one
1 17 million six hundred thousand pounds or more for
1 18 bovine."
1 19 #4. Page 6, by inserting after line 17 the
1 20 following:
1 21 "(3) A civil penalty of not more than one thousand
1 22 dollars may be imposed on an authorized entity which
1 23 directly or indirectly owns, controls, or contracts
1 24 for the care and feeding of animals having an animal
1 25 weight capacity exceeding the amount allowed pursuant
1 26 to subsection 2A. The authorized entity shall divest
1 27 the interest held by the authorized entity in the
1 28 animals to comply with subsection 2A. The court may
1 29 determine the method of divesting an interest held by
1 30 an authorized entity found to be in violation of
1 31 subsection 2A. A financial gain realized by an
1 32 authorized entity which disposes of an interest held
1 33 in violation of subsection 2A shall be forfeited to
1 34 the general fund of the state. All court costs and
1 35 fees shall be paid by the authorized entity holding
1 36 the interest in violation of subsection 2A."
1 37 #5. Page 6, by inserting after line 17 the
1 38 following:
1 39 "Sec. ___. Section 9H.5A, subsection 3, paragraph
1 40 g, Code 1997, is amended to read as follows:
1 41 g. The approximate number of livestock, including
1 42 cattle, sheep, swine, ostriches, rheas, emus, or
1 43 poultry, owned, contracted for, or kept by the
1 44 corporation, limited liability company, trust, or
1 45 limited partnership, and the approximate number of
1 46 offspring produced from the livestock. An authorized
1 47 entity shall report the largest animal weight capacity
1 48 for each species of animal directly or indirectly
1 49 owned, controlled, or contracted for by the authorized
1 50 entity."
