1 2 #1. Page 3, by inserting after line 14 the
1 3 following:
1 4 "6. a. Except as provided in paragraph "b", a
1 5 franchisor shall allow a franchisee to obtain
1 6 equipment, fixtures, supplies, and services used in
1 7 the establishment and operation of the franchised
1 8 business from sources of the franchisee's choosing,
1 9 provided that such goods and services meet standards
1 10 as to their nature and quality promulgated by the
1 11 franchisor.
1 12 b. Paragraph "a" does not apply to reasonable
1 13 quantities of inventory goods or services, including
1 14 display and sample items, that the franchisor requires
1 15 the franchisee to obtain from the franchisor or its
1 16 affiliate, but only if the goods or services are
1 17 central to the franchised business and either are
1 18 actually manufactured or produced by the franchisor or
1 19 its affiliate, or incorporate a trade secret owned by
1 20 the franchisor or its affiliate."
