                                   QUORUM CALL

         Senator Horn requested a non record roll call to determine that a
    quorum was present.

         The vote revealed 45 present, 5 absent and a quorum present.

                                BUSINESS PENDING

    House File 2

         The Senate resumed consideration of House File 2, a bill for  an
    act applying the death penalty or life imprisonment for the offense of
    first degree murder, by establishing circumstances under which the death
    penalty will be applied, by providing a minimum age for imposition of a
    death sentence, by providing for review of death sentences, by providing
    for execution by lethal injection, by amending the rules of criminal
    procedure, and by providing an effective date and for the Acts
    applicability, previously deferred.

         Senator Bisignano offered amendment S-3092 filed by Senators
    Bisignano, Banks and Priebe from the floor to pages 4, 5, 7-11, 13, and
    17-19 of the bill and moved its adoption.

         Amendment S-3092 lost by a voice vote.

         Senator Fraise took the chair at 2:20 p.m.

         President Boswell took the chair at 2:25 p.m.

         Senator Bisignano moved that the bill be read the last time now and
    placed upon its passage, which motion prevailed by a voice vote, and the
    bill was read the last time.

         On the question Shall the bill pass? (H.F. 2) the vote was:
