The contract will contain benchmarks and 6 26 performance measures which the department shall monitor. The 8 14 department shall, to the fullest extent possible, develop 8 15 cooperative efforts for advertising with contributions from 8 16 other sources. 8 17 6. BUSINESS CONSORTIA AND SUPPLIER NETWORK TRAINING 8 18 For deposit in the workforce development fund for training 8 19 directed at specific needs of businesses involved with 8 20 business consortia and supplier networks on the condition that 8 21 training shall not be provided to a business which uses 8 22 outsourcing: 8 23 .................................................. $ 150,000 8 24 Sec. 2. Notwithstanding section 15E.120, subsections 5, 6, 8 25 and 7, and section 15.287, there is appropriated from the Iowa 8 26 community development loan fund all the moneys available 8 27 during the fiscal year beginning July 1, 1996, and ending June 8 28 30, 1997, to the department of economic development for the 8 29 rural development program to be used by the department for the 8 30 purposes of the program. 8 31 Sec. 3. Notwithstanding section 15.251, subsection 2, 8 32 there is appropriated from the job training fund to the 8 33 department of economic development for the fiscal year 8 34 beginning July 1, 1996, and ending June 30, 1997, the 8 35 following amounts, or so much thereof as is necessary, to be 9 1 used for the purposes designated: 9 2 For administration of chapter 260E, including salaries, 9 3 support, maintenance, miscellaneous purposes, and for not more 9 4 than the following full-time equivalent positions: 9 5 .................................................. $ 160,000 9 6 .............................................. FTEs 2.40 9 7 Appropriations to the department of economic development 9 8 for administration of chapter 260E and the department of 9 9 employment services for the target alliance program shall be 9 10 funded on a proportional basis if receipts to the job training 9 11 fund are insufficient to fund both appropriations in their 9 12 entirety. 9 13 Sec. 4. Of all funds appropriated to or receipts credited 9 14 to the job training fund created in section 260F.6, subsection 9 15 1, up to $125,000 for the fiscal year beginning July 1, 1996, 9 16 and ending June 30, 1997, and some or all of the full-time 9 17 equivalent positions may be used for the administration of the 9 18 Iowa small business new job training Act. 9 19 Sec. 5. Notwithstanding section 8.33, funds remaining 9 20 unobligated on June 30, 1996, in the Wallace technology 9 21 transfer foundation shall be used by the department to develop 9 22 a strategic plan for technology transfer and to support 9 23 technology transfer. 9 24 Sec. 6. The Iowa seed capital corporation shall not make 9 25 any new investments after June 30, 1996. The portfolio of 9 26 investments held by the seed capital corporation on June 30, 9 27 1996, shall be transferred to a private entity for management 9 28 of the investments. Notwithstanding section 8.33, funds 9 29 remaining unobligated in the Iowa seed capital corporation 9 30 fund at the close of fiscal year 1995-1996 shall be 9 31 transferred to the housing program fund created in section 9 32 16.40. 9 33 Sec. 7. There is appropriated from the general fund of the 9 34 state to the Iowa state university of science and technology 9 35 for the fiscal year beginning July 1, 1996, and ending June 10 1 30, 1997, the following amounts, or so much thereof as is 10 2 necessary, to be used for the purposes designated: 10 3 1. For funding and maintaining in their current locations 10 4 the existing small business development centers, and for not 10 5 more than the following full-time equivalent positions: 10 6 .................................................. $ 1,216,245 10 7 ............................................... FTEs 46.42 10 14 It is the intent of the general assembly that the incentive 10 15 program focus on Iowa industrial sectors and seek 10 16 contributions and in-kind donations from businesses, 10 17 industrial foundations, and trade associations and that moneys 10 18 for the institute for physical research and technology 10 19 industrial incentive program shall only be allocated for 10 20 projects which are matched by private sector moneys for 10 21 directed contract research or for nondirected research. The 10 22 match required of small businesses as defined in section 10 23 15.102, subsection 4, for directed contract research or for 10 24 nondirected research shall be $1 for each $3 of state funds. 10 25 The match required for other businesses for directed contract 10 26 research or for nondirected research shall be $1 for each $1 10 27 of state funds. The match required of industrial foundations 10 28 or trade associations shall be $1 for each $1 of state funds. 10 29 Iowa state university shall report annually to the joint 10 30 appropriations subcommittee on economic development of the 10 31 senate and house appropriations committees the total amounts 10 32 of private contributions, the proportion of contributions from 10 33 small businesses and other businesses, and the proportion for 10 34 directed contract research and nondirected research of benefit 10 35 to Iowa businesses and industrial sectors. 11 1 Notwithstanding section 8.33, moneys appropriated for any 11 2 fiscal year which remain unobligated and unexpended at the end 11 3 of the fiscal year shall not revert but shall be available for 11 4 expenditure the following fiscal year. 11 5 Sec. 8. There is appropriated from the general fund of the 11 6 state to the state university of Iowa for the fiscal year 11 7 beginning July 1, 1996, and ending June 30, 1997, the 11 8 following amount, or so much thereof as is necessary, to be 11 9 used for the purpose designated: 11 10 For funding the advanced drug development program at the 11 11 Oakdale research park and for not more than the following 11 12 full-time equivalent positions: 11 13 .................................................. $ 319,169 11 14 ............................................... FTEs 2.85 11 15 The board of regents shall submit a report on the progress 11 16 of regents institutions in meeting the strategic plan for 11 17 technology transfer and economic development to the 11 18 chairpersons of the joint appropriations subcommittee on 11 19 economic development, the joint appropriations subcommittee on 11 20 education, the majority leader, and minority leader of the 11 21 senate, the majority and minority leaders of the house of 11 22 representatives, the secretary of the senate, the chief clerk 11 23 of the house of representatives, and the legislative fiscal 11 24 bureau by December 1, 1996. 11 25 Sec. 9. DEPARTMENT OF EMPLOYMENT SERVICES. There is 11 26 appropriated from the general fund of the state, to the 11 27 department of employment services for the fiscal year 11 28 beginning July 1, 1996, and ending June 30, 1997, the 11 29 following amounts, or so much thereof as is necessary, for the 11 30 purposes designated, including that the department of 11 31 employment services, the department of personnel, and the 11 32 department of management shall ensure that all nonsupervisory 11 33 full-time equivalent positions authorized and funded for the 11 34 department of employment services in this section will be 11 35 utilized during the fiscal year beginning July 1, 1996, and 12 1 ending June 30, 1997, and during future fiscal years, and will 12 2 not be held vacant, to ensure that the backlog of cases in 12 3 that department will be reduced as rapidly as possible: 12 4 1. DIVISION OF LABOR SERVICES 12 5 For salaries, support, maintenance, miscellaneous purposes, 12 6 and for not more than the following full-time equivalent 12 7 positions contingent upon the enactment of section 11 of this 12 8 Act and the provision which requires moneys appropriated from 12 9 the special employment security contingency fund to first be 12 10 used to fully fund the appropriation of $296,000 to the 12 11 division of labor services in subsection 1 of section 12 of 12 12 this Act prior to funding the appropriation in section 12 of 12 13 this Act to the division of industrial services: 12 14 .................................................. $ 2,554,542 12 15 ............................................... Workforce investment program 13 28 For allocating $425,000 for funding, to the extent 13 29 possible, the currently existing high technology 13 30 apprenticeship programs, under section 260C.44 at the 13 31 community colleges, and for the purposes of the workforce 13 32 investment program, for a competitive grant program by the 13 33 department for projects that increase Iowa's pool of available 13 34 labor via training and support services with priority given to 13 35 projects which serve displaced homemakers or welfare 14 1 recipients, including salaries and support: 14 2 .................................................. $ 903,000 14 3 The department shall ensure that the workforce investment 14 4 program is coordinated with services provided under the 14 5 federal Job Training Partnership Act and that welfare 14 6 recipients receive priority for services under both programs. 14 7 Notwithstanding section 8.33, moneys committed to grantees 14 8 under contract that remain unexpended at the end of the fiscal 14 9 year, shall not revert to any fund but shall be available for 14 10 expenditure for purposes of the contract during the succeeding 14 11 fiscal year. 14 12 c. Labor management councils 14 13 For salaries, support, maintenance, miscellaneous purposes, 14 14 and for not more than the following full-time equivalent 14 15 positions: 14 16 .................................................. $ 100,338 14 17 ............................................... The department shall not use moneys appropriated 14 23 in this lettered paragraph for grants to grantees who do not 14 24 facilitate the active participation of labor as members of 14 25 labor management councils or who fail to make a good faith 14 26 effort to either schedule meetings during nonworking hours or 14 27 obtain voluntary agreements with employers to allow employees 14 28 time off to attend labor management council meetings with no 14 29 loss of pay or other benefits. 14 30 Sec. 10. Notwithstanding section 15.251, subsection 2, 14 31 there is appropriated from the job training fund to the 14 32 department of employment services for the fiscal year 14 33 beginning July 1, 1996, and ending June 30, 1997, the 14 34 following amount, or so much thereof as is necessary, to be 14 35 used for the purpose designated: 15 1 For the target alliance program: 15 2 .................................................. $ 30,000 15 3 Sec. 11. ADMINISTRATIVE CONTRIBUTION SURCHARGE FUND. 15 4 There is appropriated from the administrative contribution 15 5 surcharge fund of the state to the department of employment 15 6 services for the fiscal year beginning July 1, 1996, and 15 7 ending June 30, 1997, the following amount, or so much thereof 15 8 as is necessary, for the purposes designated: 15 9 DIVISION OF JOB SERVICE 15 10 Notwithstanding section 96.7, subsection 12, paragraph "c", 15 11 for salaries, support, maintenance, conducting labor 15 12 availability surveys, miscellaneous purposes, and for not more 15 13 than the following full-time equivalent positions: 15 14 .................................................. $ 6,310,000 15 15 ............................................... However, 15 20 this provision shall not prevent the consolidation of multiple 15 21 offices within the same city or the colocation of workforce 15 22 centers with another public agency. 15 23 2. The division of industrial services shall not reduce 15 24 the number of scheduled hearings of contested cases or 15 25 eliminate the venue of such hearings, as established by the 15 26 division for the period beginning January 1, 1996, and ending 15 27 January 20, 1997. The division shall also establish a 15 28 substantially similar schedule for such hearings for the 15 29 period beginning January 20, 1997, and ending June 30, 1997. 15 30 The division shall report to the legislative fiscal bureau 15 31 concerning any modification of the established schedule, or 15 32 any changes which the division determines are necessary in 15 33 establishing the schedule for the period beginning January 20, 15 34 1997, and ending June 30, 1997. 15 35 3. The division shall continue charging a $65 filing fee 16 1 for workers' compensation cases. The filing fee shall be paid 16 2 by the petitioner of a claim. However, the fee can be taxed 16 3 as a cost and paid by the losing party, except in cases where 16 4 it would impose an undue hardship or be unjust under the 16 5 circumstances. 16 6 Sec. 12. EMPLOYMENT SECURITY CONTINGENCY FUND. There is 16 7 appropriated from the special employment security contingency 16 8 fund to the department of employment services for the fiscal 16 9 year beginning July 1, 1996, and ending June 30, 1997, the 16 10 following amounts, or so much thereof as is necessary, for the 16 11 purposes designated and subject to the requirement that the 16 12 appropriation to the division of labor services under this 16 13 section be fully funded from the special employment security 16 14 contingency fund prior to any amounts being used to fund the 16 15 appropriation made to the division of industrial services 16 16 under this section: 16 17 1. DIVISION OF LABOR SERVICES 16 18 For salaries, support, maintenance, and miscellaneous 16 19 purposes: 16 20 .................................................. $ 296,000 16 21 2. DIVISION OF INDUSTRIAL SERVICES 16 22 For salaries, support, maintenance, and miscellaneous 16 23 purposes: 16 24 .................................................. $ 175,000 16 25 Any additional penalty and interest revenue may be used to 16 26 accomplish the mission of the department. 16 27 Sec. 13. PUBLIC EMPLOYMENT RELATIONS BOARD. There is 16 28 appropriated from the general fund of the state to the public 16 29 employment relations board for the fiscal year beginning July 16 30 1, 1996, and ending June 30, 1997, the following amount, or so 16 31 much thereof as is necessary, for the purposes designated: 16 32 For salaries, support, maintenance, miscellaneous purposes, 16 33 and for not more than the following full-time equivalent 16 34 positions: 16 35 .................................................. $ 777,164 17 1 ............................................... FTEs 12.80 17 2 Sec. 14. There is appropriated from the general fund of 17 3 the state to the Iowa finance authority for the fiscal year 17 4 beginning July 1, 1996, and ending June 30, 1997, the 17 5 following amount, or so much thereof as is necessary, to be 17 6 used for the purpose designated: 17 7 For deposit in the housing improvement fund created in 17 8 section 16.100 for purposes of the fund: 17 9 .................................................. $ 700,000 17 10 Sec. 15. NEW SECTION. 15.113 ECONOMIC DEVELOPMENT 17 11 ASSISTANCE – REPORT. 17 12 The business development division of the department shall 17 13 provide a report to the general assembly by January 15 of each 17 14 year regarding all assistance or benefits provided under the 17 15 community economic betterment program, the new jobs and income 17 16 program, and the Iowa industrial new jobs training Act. The 17 17 report shall contain a breakdown of each type and amount of 17 18 assistance received by each business, including local and 17 19 state tax abatements, grants, loans, and job-training moneys. 17 20 The department shall coordinate this report with the 17 21 department of revenue and finance, the department of 17 22 employment services, and the department of education. 17 23 Sec. 16. NEW SECTION. 15.114 MICROBUSINESS RURAL 17 24 ENTERPRISE ASSISTANCE. 17 25 1. As used in this section: 17 26 a. "Department" means the department of economic 17 27 development. 17 28 b. "Microbusiness" or "microbusiness enterprise" means a 17 29 business producing services with five or fewer full-time 17 30 equivalent employee positions and with assistance requirements 17 31 of not more than twenty-five thousand dollars. 17 32 c. "Microbusiness organization" means a nonprofit 17 33 corporation organized under chapter 504A which is exempt from 17 34 taxation pursuant to section 501(c) of the Internal Revenue 17 35 Code and which has a principal mission of actively engaging in 18 1 microbusiness development, training, technical assistance, and 18 2 capital access for the start-up or expansion of 18 3 microbusinesses. 18 4 2. The department shall contract with a microenterprise 18 5 organization actively engaged in microbusiness enterprise to 18 6 assist in the establishment of this program. In order to 18 7 qualify for the contract, the microenterprise organization 18 8 shall do all of the following: 18 9 a. Demonstrate a past performance of and a capacity to 18 10 successfully engage in microbusiness development. 18 11 b. Have a statewide commitment to and focus on 18 12 microbusiness development. 18 13 c. Provide training and technical assistance. 18 14 d. Demonstrate an ability to provide access to capital for 18 15 start-up or expansion of a microbusiness. 18 16 e. Have established linkages with financial institutions. 18 17 f. Demonstrate an ability to provide follow-up technical 18 18 assistance after a microbusiness start-up or expansion. 18 19 3. Moneys allocated pursuant to this section which remain 18 20 unexpended or unobligated at the end of a fiscal year shall 18 21 remain available to the department to support the assistance 18 22 program or may be credited to the value-added agricultural 18 23 products and processes financial assistance fund created in 18 24 section 15E.112 and shall not revert notwithstanding section 18 25 8.33. 18 26 4. The department shall submit a report in accordance with 18 27 section 7A.11 not later than November 1 of each year detailing 18 28 the activities of the microenterprise organization and 18 29 describing the success of the project. 18 30 Sec. 17. Section 15.313, subsection 2, Code 1995, is 18 31 amended by adding the following new paragraphs: 18 32 NEW PARAGRAPH. g. The entrepreneurs with disabilities 18 33 program, which provides technical and financial assistance to 18 34 help persons with disabilities become self-sufficient and 18 35 create additional employment opportunities by establishing or 19 1 expanding small business ventures. 19 2 NEW PARAGRAPH. h. The disabled job opportunities program, 19 3 which provides service and technical assistance to 19 4 rehabilitation organizations or agencies that create, expand, 19 5 or spin off business ventures for persons with disabilities. 19 6 Sec. 18. Section 15.343, Code Supplement 1995, is amended 19 7 by adding the following new subsection: 19 8 NEW SUBSECTION. 4. Funds provided through the workforce 19 9 development fund shall not be used to fund out-of-state travel 19 10 or drug testing. 19 11 Sec. 19. NEW SECTION. 15A.4 COMPETITIVE PROGRAMS – GOOD 19 12 NEIGHBOR AGREEMENT – ADDITIONAL CONSIDERATION. 19 13 For any program providing financial assistance for economic 19 14 development in which the assistance is provided on a 19 15 competitive basis, a business which enters into a good 19 16 neighbor agreement shall receive extra consideration of at 19 17 least ten points or the equivalent. A good neighbor agreement 19 18 is an agreement by the business to provide a report containing 19 19 the results of the business's water and air discharge 19 20 analyses, efforts to reduce air and water pollution, and 19 21 efforts to mitigate noise, light, hazardous material storage, 19 22 transportation, and traffic problems and to maintain a file of 19 23 all public environmental and occupational safety and health 19 24 documents filed with the federal and state agencies related to 19 25 the local facility of the business. 19 26 A business which fails to abide by the good neighbor 19 27 agreement shall repay all financial assistance received under 19 28 the program. 19 29 Sec. 20. Section 159A.7, subsection 3, Code 1995, is 19 30 amended to read as follows: 19 31 3. Until July 1, 2000, moneys shall be deposited in the 19 32 fund as provided in section 423.24. Not more thanone and19 33one-halffour percent of the total moneys available to support 19 34 value-added agricultural products and processes pursuant to 19 35 section 423.24 shall be allocated to the department for 20 1 administration of the office. 20 2 Sec. 21. Section 260E.3, Code Supplement 1995, is amended 20 3 by adding the following new subsection: 20 4 NEW SUBSECTION. 6. An agreement to establish or modify a 20 5 project shall provide that funds for the project shall not be 20 6 used for out-of-state travel or drug testing. 20 7 Sec. 22. Section 260F.3, Code 1995, is amended by adding 20 8 the following new subsection: 20 9 NEW SUBSECTION. 9. An agreement to establish or modify a 20 10 project shall provide that funds for the project shall not be 20 11 used for out-of-state travel or drug testing. 20 12 Sec. 23. Notwithstanding sections 15.108, 15.224 through 20 13 15.230, 15.347, 15.348, and 239.22, the department of 20 14 employment services shall administer the following programs: 20 15 job training partnership Act, Iowa conservation corps, 20 16 americorps, mentoring for PROMISE JOBS, food stamp employment 20 17 and training, and the labor/management co-op programs. 20 18 Sec. 24. FEDERAL GRANTS. All federal grants to and the 20 19 federal receipts of agencies appropriated funds under this 20 20 Act, not otherwise appropriated, are appropriated for the 20 21 purposes set forth in the federal grants or receipts unless 20 22 otherwise provided by the general assembly. 20 23 EXPLANATION 20 24 This bill makes appropriations and transfers from the 20 25 general fund and other funds to the department of economic 20 26 development, the Iowa finance authority, the insurance 20 27 division of the department of commerce, the university of 20 28 Iowa, Iowa state university, the department of employment 20 29 services, and the public employment relations board. 20 30 The bill also provides as follows: 20 31 1. The business development division of the department of 20 32 economic development is to provide a report to the general 20 33 assembly regarding all assistance and benefits provided under 20 34 the community economic betterment program, the now jobs and 20 35 income program, and the Iowa industrial new jobs training Act 21 1 (chapter 260E). 21 2 2. Two new programs are added to those which may be funded 21 3 through the strategic investment fund, the entrepreneurs with 21 4 disabilities program and the disabled job opportunity program. 21 5 3. Funds provided under the workforce development fund or 21 6 chapter 260E or 260F (small business new jobs training) shall 21 7 not be used for drug testing or out-of-state travel. 21 8 4. Any business seeking competitively awarded economic 21 9 development financing assistance shall receive additional 21 10 consideration if it enters into a good neighbor agreement 21 11 regarding pollution mitigation efforts which shall be open to 21 12 public inspection. 21 13 5. The amount which may be spent for administration of the 21 14 office of renewable fuels and coproducts is increased from 1.5 21 15 to 4 percent of the total moneys available to support value- 21 16 added agricultural products and processes. 21 17 6. The job training partnership Act, Iowa conservation 21 18 corps, Americorps, mentoring for PROMISE JOBS, food stamp 21 19 employment and training, and the labor/management coop 21 20 programs are to be administered by the department of 21 21 employment services. 21 22 LSB 3391SA 76 21 23 mk/jj/8.1
