1 1 Section 1. Section 811.2, subsection 1, Code 1995, is
1 2 amended by adding the following new unnumbered paragraph:
1 3 NEW UNNUMBERED PARAGRAPH. In addition to any condition of
1 4 release required to reasonably assure the defendant's
1 5 appearance and the safety of other persons, the magistrate may
1 6 order as a condition of release that the defendant submit to
1 7 and complete a substance abuse evaluation within thirty days,
1 8 if the magistrate determines that there is reason to believe
1 9 that the defendant regularly abuses alcohol or other
1 10 controlled substances and may be in need of treatment.
1 11 EXPLANATION
1 12 This bill provides that a magistrate may order, as a
1 13 condition of pretrial release, that the defendant undergo a
1 14 substance abuse evaluation, if the magistrate has reason to
1 15 believe that the defendant abuses alcohol or a controlled
1 16 substance.
