1 1 Section 1. NEW SECTION. 72.1A PRIVATIZATION CONTRACTS –
1 2 WAGES AND BENEFITS.
1 3 Officers empowered to expend, or direct the expenditure of,
1 4 public moneys of the state shall not enter into any contract
1 5 which contemplates an expenditure of moneys to transfer the
1 6 performance of services provided by the state using state
1 7 employees as of the end of the previous fiscal year to an
1 8 independent contractor or employees other than state employees
1 9 or to provide new state services using an independent
1 10 contractor or employees other than state employees, unless the
1 11 wages or their equivalents paid to the independent contractors
1 12 or private employees performing the services are equal to or
1 13 exceed the wages paid to state workers who were performing the
1 14 services or to state workers performing comparable services
1 15 and unless the benefits paid to the independent contractors or
1 16 private employees are comparable to those paid state
1 17 employees.
1 18 EXPLANATION
1 19 This bill provides that a contract for the privatization of
1 20 state services require that the wages paid the independent
1 21 contractors or private employees be at or above those paid to
1 22 state employees performing the same or comparable work and
1 23 that the independent contractors or private employees receive
1 24 benefits comparable to those received by state employees.
