PAG LIN 1 1 Section 1. Section 15A.1, Code 1995, is amended by adding 1 2 the following new subsection: 1 3 NEW SUBSECTION. 4. A private person receiving public 1 4 funds or other economic development assistance under 1 5 subsection 2 shall, if the business operated by the private 1 6 person is moved out of the state within ten years of the date 1 7 the last assistance is received by the private person, provide 1 8 medical insurance, job training funds, and supplemental 1 9 unemployment benefits to the workers displaced by the business 1 10 leaving the state. Medical insurance shall be provided on the 1 11 same terms as it was provided during the period the business 1 12 was operated in this state and shall terminate at the end of 1 13 two years or the date upon which the employee obtains a new 1 14 job with substantially the same medical benefits, whichever is 1 15 earlier. Job training funds and supplemental unemployment 1 16 benefits shall be determined by the department of economic 1 17 development and the department of employment services, 1 18 respectively. 1 19 A private person who fails to comply with this subsection 1 20 shall repay to the state, a city, or a county all economic 1 21 development assistance received by the private person for the 1 22 business. 1 23 EXPLANATION 1 24 This bill provides that a person who receives economic 1 25 development assistance from the state, a city, or a county 1 26 shall provide health insurance, job training funding, and 1 27 supplemental unemployment payments to employees displaced by 1 28 the relocation of the business for which the assistance was 1 29 received out of the state. A person who fails to do this is 1 30 required to repay all economic development assistance received 1 31 for the business. 1 32 Health insurance provided shall be on the same terms as it 1 33 was provided while the business was located in the state. The 1 34 insurance shall be provided for the shorter duration of two 1 35 years or until the employee is employed at a new job which 2 1 provides substantially the same health benefits. 2 2 Job training and supplemental employment assistance are to 2 3 be provided at the level determined by the department of 2 4 economic development and the department of employment 2 5 services, respectively. 2 6 LSB 4351XC 76 2 7 mk/sc/14
