  1  1    Section 1.  Section 124.401, subsection 1, paragraph b,
  1  2 subparagraph (5), Code 1995, is amended to read as follows:
  1  3    (5)  Not More than one gram but not more than ten grams of
  1  4 a mixture or substance containing a detectable amount of
  1  5 lysergic acid diethylamide (LSD).
  1  6    Sec. 2.  Section 124.401, subsection 1, paragraph c, Code
  1  7 1995, is amended by adding the following new subparagraph (5)
  1  8 and renumbering the subsequent subparagraphs:
  1  9    NEW SUBPARAGRAPH.  (5)  One gram or less of a mixture or
  1 10 substance containing a detectable amount of lysergic acid
  1 11 diethylamide (LSD).  
  1 12                           EXPLANATION
  1 13    This bill pertains to the penalties for the unlawful
  1 14 manufacture, delivery, or possession with the intent to
  1 15 manufacture or deliver lysergic acid diethylamide (LSD).
  1 16 Current law provides that with respect to not more than 10
  1 17 grams of a mixture or substance containing a detectable amount
  1 18 of LSD, the offense is a class "B" felony subject to a fine of
  1 19 not less than $5,000 and not more than $100,000, in addition
  1 20 to penalties as provided in section 902.9, which provides a
  1 21 term of confinement of no more than 25 years.  The bill
  1 22 provides that if one gram or less of LSD is involved, the
  1 23 offense is a class "C" felony, subject to a fine of not less
  1 24 than $1,000 and not more than $50,000, in addition to
  1 25 penalties as provided in section 902.9, which provides a term
  1 26 of confinement of no more than 10 years.
